First, take down the image in question and all other questionable images.

Second, educate yourself.  There is lots of information on this site regarding how to deal with your situation.  There is no one size fits all strategy.  Get educated, then determine what's best for you and your client.

I suggest you research this topic on this forum.  Multiple court jurisdictions have ruled that hot linking is NOT copyright infringement.  I am not a lawyer, but I would guess a plug-in is a lot like lot linking.  If the image in question has never been hosted on your site, I would think you are on strong legal ground.

Knowing nothing about your case, if I had to bet on it, I would bet that no one would sue your for $500.

That said, there are reasons they might want to sue you.  If you gave them incriminating evidence in your email correspondence, that might up the likelihood of a suit.  If the photo in question required a model release, that might up the likelihood of a suit.  There are certainly lots of details like these that might up the likelihood of a suit.

The best thing you could do is learn as much as you can about the situation from others who have been through it.  This site is full of that kind of stuff.  The more you understand, the better you can gauge the likelihood in your specific case, and come to a sound judgement.

There is no substitute for getting educated.

They might be able to find copies of your site, as of a particular date, on some site that archives the web, such as the www.waybackmachine.org.

If you do not explicitly ask them to remove copies, this would be a way to provide third party evidence of what once was.

This is a particular sore spot with me because Getty has specifically removed large sections of their web presence over the years from archive sites like the waybackmachine.  The sections they have removed may justify the legal arguments of alleged copyright violators that the images that were removed were available for free at a particular time in history, and Getty changed their policy.

I have not been pushed so far as to check if a subpoena could get at the information the waybackmachine does not share.  My guess is that they don't save it - if they were requested to remove it.

It is admirable that James83 wants to take care of this for his client, but Getty doesn't care.  Getty has no claim against James83.

You need to understand that from their perspective, the phone call with you is a phishing expedition.  They will use what they learn against you or your client.

If you want to offer them $100, I would recommend you do it in writing (certified letter, not email).  I don't expect it will work. 

Read the forum.  Their are lots of examples of people's experience making offers of all kinds to Getty.  The more educated you are with how they have dealt with others, the better understanding you will have of what you and your client can expect.

They clearly gave you the wrong reference number.  I can't find it either.

You should know that the Digital Media Copyright Act does not require a copyright notification on images for the copyright to be enforceable.  As a software guy, this is something I don't understand.  So, they may be justified in their request.

That said, a lot of other things need to be right for them ever to collect anything.  However, if they do choose to pursue this, it might cost you a lot more than $100 to be proven right - and you might not be.

My suggestion is either pay them or ignore them.  There is no middle ground.  You can't hire an attorney in any capacity for less than $100.  Knowing that the image has been removed, they may choose not to pursue it.  On the other hand, if they choose to pursue it, you might be left wondering why you didn't take the cheap $100 way out.

You can try, but you should understand that Getty just cares about the money. 

If you roll over and pay, it will work, they will leave him alone.

If you give them too much push back in trying to negotiate, they will play you off against the client, trying to get paid.  If you let them know that you built the site for a client, they will sense weakness and two pigeons instead of one.  Your job will be harder.

You can hire an attorney (like Oscar) to represent the client, in which case, they can only communicate with the attorney, accomplishing your goal of insulating the client without necessarily letting them know that you are paying the attorney's bill.  If this is of interest to you, you should check out Oscar's letter writing program on this site.  Most everyone he represents through that program seems delighted with the result.

Whatever you choose to do, get educated first and don't let them know that it was your mistake on behalf of your client.  That will only make your job tougher.

If the image in question was hotlinked and never uploaded to your server, I think you might have nothing to worry about.

Go to the Getty images forum and search for hotlinked image.  You will find a lot of information about hot linking and why it is not illegal.

None of your other "Facts" really matter, nor do the questions.  Copyright applies to the owner the moment a photo is taken.  The application for the copyright increases the damages one could get from the court for an infringement, but I don't think the court will find hotlinking to be infringing.  Whether or not you made money with the photo has no bearing under the law, to my understanding.

How you choose to deal with the notification is another question.  Take the time to get educated on this forum because that will be a personal choice.  It becomes a trade-off of time versus money, aggravation versus money, etc.  If I were in your shoes I might choose to:
  • Ignore them knowing the law is on my side, or
  • Write them one letter explaining that they should not be making harassing accusations without getting their facts straight.  Depending on what their letter looked like, I might cite cases where the courts have held that hotlinking is not a copyright violation, or not - depending on my tolerance level that day.

That's just me.  I am not a lawyer, but a business owner like you.  Others might want to get in Oscar's letter writing program, which you could find details of on this site.  For something like $200, he will write the letter for you which will prohibit them from any further contact (and bother) with you.

First, you need to understand that they are not here to settle on something fair, they are here to get all they can.  Let me try to explain why you are asking for what you asked for:

1) The image is properly registered.  - This determines how much they might collect in court.  Maximum damages are different for a properly registered image than a non registered image.
2) The have the exclusive rights to the image. - This determines if they have the right to ask for anything.  Only one entity may hold the right to pursue copyright infringement.  This is usually where the trolls slip up.  That's why they usually avoid answering this question.
3) The provide a signed agreement showing the owner of the work has given Getty the right to collect monies on behalf of the artist. - This agreement will tell what kind of relationship Getty has with the artists.  If the artist did not transfer full rights to the image to Getty, Getty cannot pursue copyright infringement and win.
4) Show sales for the last 24 months on the image justifying the amount they are requesting - Generally a court will ask this to keep their demands in line.  They should be asking for something reasonable.

  What is this rights holders form and what does it say?  Is it signed and dated by both Getty and the photographer?  If not, it may not hold up in court.

You can play the letter game with them, if you like.  It may ease your conscience.  Generally, it results in them pursuing you harder because it lets them know you have a conscience.  If you choose to play the letter game, be careful that you do not reveal anything that may be detrimental to your cause should this thing escalate.  It likely won't.

Well said, Matt.  I agree whole heartedly.

It takes a few years of watching these guys before one realizes they are playing TEGWAR (the exciting game without any rules) and they are using the U.S. Legal system as their partner in this deceptive game.
