Hi all.  Long-time reader, first time poster......

I too sent a complaint to the WA ATG and received a response back from Getty.  It seemed to be somewhat of a form letter, but there were specific details filled in.  Of course, no proof of copyright ownership/representation or an explanation of their demand amount, but that goes without saying. 

Is there a way to find out how many claims have been filed against them with the ATG office?

AS recent as May of this year there have been almost 60 complaints files, you can find them all here:

yes Getty always answers with a generic form letter, and never gives any proof of the claim..typical behavior.. Depending on when you filed your complaint it just might be in this bunch

Thanx for the name drop, I'll promptly add Janea Davis to the ever growing list of copyright trolls..Mulligan sums it up nicely..3 years of threatening letters, never showing any proof. wasn't the image in question incorporated into something in your portfolio??, they tried this crap before to no avail...

LOL, when Mulligan first got here, he was shitting all over himself on a daily basis, but we cured him of that.

Las Vegas copyright lawsuit company Righthaven LLC suffered another setback Wednesday when an appeals court dismissed one of its appeals.

The dismissal was requested by the nonprofit Center for Intercultural Organizing (CIO) in Portland, Ore., which won a key fair-use ruling last year against Righthaven.

The dismissal was granted Wednesday by the 9th U.S. Circuit Court of Appeals in San Francisco, which cited case law that appeared to back arguments by the CIO that Righthaven could no longer participate in the case since creditors had seized the copyrights it sues over. In layman’s terms, the CIO argued Righthaven no longer had a dog in the fight so the fight was over.

Quick update on this case. Getty has answered the complaint, with the usual denials, so this will be slowly dragging thru the system as each point in the complaint is addressed.

I'd like to get others opinions on this one portion of the answer, am I reading into this correctly, or am I totally of base in my thinking.

From Page 16 - Paragraph 8
8. The FAC is barred, in whole or in part, because any damages allegedly suffered by Plaintiff were either wholly or in part the legal fault of persons, firms,corporations, or entities other than Getty Images, and that legal fault reduces the percentage of responsibility, if any, which is to be borne by Getty Images.

Seems to me Getty Images has sent out plenty of extortion demand letters, where the recipient was given permission, by a supplier or vendor in which there may have been elements of a Getty Image, yet when told this they see it as a non valid defense, and still want the money...So once again whats good the goose is not good for the gander.. Getty Images are hypocrites on just about every level!

Typical form letter from Getty, skirting the issues, not addressing anything, and claiming the recipient has shown no valid defenses.. I think it's high time we put on our collective thinking caps and conatct the Attorney General himself ( not his clerks) I may be calling April Brown on this, she lives near Seattle, it's an election year, and the AG would surely like another vote, he might just speak with her...Just need to get a solid plan of action together. IT's time that someone, somewhere look into the fact that Getty Images continues to avoid backing up their claims.

DMCA take downs can certainly be a time suck, as we here at ELI have had our fair share of bogus take downs. Unfortunately you can only do 2 things, one of which is sending in the counter notification, which you're doing already, the other would be to file suit IF you can prove damages, which might be difficult at best.

In regards to a database chillingeffects.org has one, it's a bear to search, but I think I recall somewhere where you can "report" bogus takedowns..

I don't think you'll find anybody to investigate the matter, that would fall to the end user (you).

Perhaps one of our Canadian users will chime in here, as maybe there is something you can do, besides issueing counter notices.

I also agree that decisions do vary...


I once went in front of a judge ( well actually more than once!) and I can remember , saying in my head over and over and over like a mantra "please let him be in a good mood"...he wasn't..time out corner for me!

Point is decisions are based on other factors, as well as "law", even with federal guidelines in place they still have some leeway.
