It is always a calculated risk in these matters. I always tell people to be careful what you say or do. Your bluff could be called.  I don't like to bluff because I don't want to be called on it. So I am careful to only say things I have every intention of following through.

I am certainly one of those people who has a bit of an attitude but I am always scanning the environment and reassessing my position. It doesn't mean I could never lose or have never lost but you certainly have to pick and choose your battles.

I am not a big proponent of simply ignoring a threat because I believe it spurs the other side more to get you. It angers them more that you are trying to dodge a bullet than facing the issue head on. Obviously, that is a simplistic statement on my part. There are many variables involved.

Hindsight is always 20/20 but I am always a big believer in covering your tracks. And that means responding even if it costs you time and energy. To not respond can have very unexpected and unintended consequences as you hinted at.

But it seems, for now, Riddick is off the map. But you can be sure, ELI will be among the first to know about it if Riddick resurrects his extortion business.

OTOH, Riddick has mostly sued with contingency lawyers who saw dollar signs and would hold on to the case like pitbulls. Telling him to pound sand when he hits you with a demand letter is one thing, but if he sues with a lawyer, you cannot afford to ignore that. You don't want to try to appeal a judgment on a case you lost because you willfully defaulted.

I wish I could talk about the specific facts of our case, but I'm prohibited by the settlement. Let me just say, a dedicated asshat with a lawyer can cause you a lot of trouble and cost you a lot of money, whether he's right or not. If you get a letter from Riddick or someone like him, don't base your legal strategy on the bravado of some anonymous board poster. Call Oscar or someone like him and get help.

I have not heard a peep from anyone regarding what Riddick is up to. I am guessing our online efforts have been a contributing reason to his disappearance. The online battle was just too much for him. He didn't have a soul on his side and he certainly didn't have anyone's respect.

Although I never had to take Riddick on directly like some of you, it is not hard for me to imagine how I might react. Hence, I understand and agree with many of your sentiments.

Sometimes you just have to take out the big hammer and use overwhelming force to prove a point and I think that is what ultimately happened.

Like all trolls, this jerk (I'm trying to keep this PG-13) should go back under his bridge.

This clown was his own worst enemy.  Picking on moms and housewives using embroidery patterns was stupid enough, but going after HP, and especially Bernina, was the textbook definition of "over-reach".  Plus I know that there are a few people here who stood up to the bully and told him to go pound sand.

If he so much as looks in my direction again, I will hit him with the force of a hurricane.

George, go back under your bridge, wallow in your misery, continue to pick the toe jam from your smelly feet, and stop wasting everyone's time with your bullying tactics.  With the internet, we are able to share information thanks to sites like this & contributors such as the participants on this board.

If you look in our collective direction again, we will CRUSH YOU.  Read that again: we will hit you back HARD.  Fines, rulings, court costs, attorney's fees,  etc.

George, if karma is real, you should be constantly looking over your shoulder, because you've certainly gone to the well too many times.

If you want to continue "enjoying and liking" your communication experience with Getty Images or anyone else on legal matters, have at it.

However, I am stunned at your response. Does it really need to be said that aggressively defending and fighting back is not meant to be a comfortable, cruise-ship experience?

In what I wrote, did you somehow get the impression that my advice was meant for YOUR, MINE, or ANYONE ELSE's personal comfort or preferred mode of communication?

Does anyone really think I enjoyed the entire experience of what I did to successfully fight back? Does anyone really think I enjoy typing up my hard-copy letters on a laser printer, running down to the U.S. Post Office, manually fill out a Certified Mail form, and paying $6 to mail it out? Seriously?

Do you think lawyers who want to seriously communicate a strong message is thinking about their personal comfort in sending their messages? I promise you that if someone decides to hire Oscar or any decent lawyer to represent a client's interests, they are not sitting back and thinking how easy the communication might be if that lawyer could only send an email on behalf of their clients instead of an envelope and postage. They aim to get the message across effectively and that almost always means snail-mail, not because lawyers are incapable or unwilling to use email.

Do you realize that MY goal in my advice to others is NOT to encourage a easy leisurely, ongoing debate with the stock photo companies? That MY goal to others is to decisively put a stop to it quickly, once and for all.

But for those of you who are much too bothered with postage, paper, and getting out of your chair although they persistently threaten the crap out of you, be my guest. But then people shouldn't complain that the emails from Getty (or whoever) continue on without stopping.

The difficulty is that if I send letters to Getty, I'll get letters from Getty. I don't like that mode of communication.  Since I don't like snail mail, I would prefer to use the mode of communication I like.

One little "mystery" appears to have been solved to my satisfaction.  I believe Hawaiian Art Network LLC is solely owned by Glen Carner. I believe this because the Hawaii Business Registration reveals it to be a single-member LLC which essentially means a single-owner. How much business or revenue he does, I cannot tell right now.

I believe HAN is a small, privately-held company with relatively few employees (less than 5 employees). Because of the relatively few employees, I believe Glen has created a "virtual" company using the Internet, joint ventures, partnering, vendors, and independent contractors. I know something of creating a virtual organization because I have done so myself.  It would explain HAN's ongoing "dependency" on outside lawyers that have come in and out of ELI's field of reporting.

And since we are on the subject of using outside lawyers, I believe the lawyers Glen hires are contingency lawyers that work approximately on a 60/40 basis. 60% goes to HAN, 40% goes to the lawyer. I make this estimation because I have dealt with other lawyers who do collections work for similar splits that vary from 70/30, 65/35, or 60/40 splits.

Regarding the recent HAN lawsuits, I am guessing that Glen had to front the court filing fees but Lawyer J. Street might split any settlement that comes from the lawsuit filing. Of course, the purpose is to try to "force" a settlement as a sustained fight in the courts would not make it worthwhile for a collections lawyer.  I base this scenario on my own experiences with law firms that did collections.  They would not front the court filing fees but would put their staff's time to prepare the paperwork.

At the end of the day, as far as I am concerned, any actions or decisions HAN makes boils down to Glen Carner.  Up to now, we have referred to actions taken by HAN as one decided by a faceless entity. The reality is all corporate entities are managed by people. He is ultimately accountable and he knows a lot of the issues we discuss here on ELI. In fact, since he is "the man", he reads nearly everything we post and monitors ELI as much as we monitor him and his cohorts.

As far as I am concerned, being part of the whole free wallpaper baiting issue is a disgrace to his actions as a business person.  It is my guess that Glen knows about it but I do not feel he is directly responsible for it. He just turns a blind eye to it. I believe the wallpaper seeding that we have seen rests on Vincent Tylor.

It appears that Copyright Services International has been cancelled. I wonder if it had anything to do with us exposing this information.  Or is it simply that the functions of that business was rolled into Hawaiian Art Network LLC.

AS many extortion letters as we have revealed, there are still many more to come from the stock photo industry. With every extortion letter that has been reported, all of them can be traced back to a client to PicScout.

Conveniently, PicScout has a link to many of their more visible clients. I feel like we need to go ahead and make room for the future extortion letters.
