if he is not well, and not able willing to get educated, I 'm going to recommend he join Oscar letter program, the only way to make it "go away" is to pay or negotiate a settlement..contacting them will no do any good, unless he wants to ride the merry go around for the next three years.

you need to direct your friend here, as he/she will be the one dealilng with this, he/she needs to get educated. At this point complaining to the AG or consumer protection is moot, what they are doing is within the law. Thats not to say that a complaint may not be warranted somewhere down the road.

::EDIT:: Masterfile is a different beast than Getty, and they have been known to file suit, and they have been known to have their ducks in a row..

Citing case law in a response is a good thing, and since getty just loves to use deadlines, I would consider throwing back at them...explain your case and that it fall under fair use, give them 10 days to respond or it will be considered that this matter is closed and over with.

you are on fairly good grounds here!, and welcome to the forum BTW. First order of business would be to advise them you will NOT be aepting any emails over this issue or phone calls, require they send everything US mail..In other words make them WORK for this.. If it was  a screen shot on a blog you were commenting on , chances are it falls under "fair use"...I would start learning about this first!.

We'd pretty much thought that the Righthaven saga was over. After all, the company had gone into receivership back in December, and the court-appointed receiver had been auctioning off what little assets the company had in an attempt to satisfy all of the court-ordered attorneys' fees that Righthaven owed to the lawyers of some of the many defendants that Righthaven sued for copyright infringement on a repeatedly-rejected legal theory. At the same time, the CEO/founder of Righthaven, Steve Gibson had stopped showing up in court, had taken another job, and was being investigated by the Nevada State Bar.

As far as the court-appointed receiver, Lara Pearson, knew, Gibson and his wife Raisha "Drizzle" Gibson (who had been "COO" of Righthaven) no longer had anything to do with the company.

keep reading the forums, just about all of us have had multiple letters...naturally they want to settle, they want your money..doesn't matter if the site exists or if the domain is expired, they have screenshots (I presume) and they most likely have info on archive.org, unless you have removed it, which I doubt, since you basically ignored the letter from the get go..

Probably not a bad omen, probably just further proof of how dis-organized, and sloppy Getty images is.. I hope I have included this underlings name on out running list, if not send it to me, as I would just hate to leave anyone out!

I don't understand why you guys get all this extra attention.  My case began with a letter from one of Timothy McCormack's underlings.  Nothing from Getty or a bill collector.  Is that a bad omen?
