I personally never believed ANYTHING that came from him, he was on a self serving mission in my opinion from the get-go. just as well he did not answer my questions, lest i would have had to keep calling him out, as I'm fairly confident I know the answers already..

This is the exact reason that Glen Carner's responses about attempts to stop the baitpaper sites totally strain credulity. Let's take a look at the Glen Carner statement regarding DMCA takedown notices, from an ELI thread just about 3 weeks old:

Yes, HAN does them continuously.  There are a few other things that we may be able to provide to quickly debunk this (even though your research could provide a quick answer if you stop looking for what you are trying to find) which hopefully I can post here shortly.  Thank you for asking though which is much appreciated vs. the shoot first ask questions later approach.

By the way, if you scroll down on that WhoIs listing, there's a section titled "related websites". Every single one has "wallpaper" as part of the domain name. What does that suggest about WallpaperSuggest.com and the company it keeps?

I have repeatedly offered to provide Glen Carner with plenty of domain names that they can have taken down. However, as I have SUGGESTED before, HAN is not interested because there's no money in sending takedown notices as opposed to sending extortion letters to the victims of free baitpaper sites.

I will, at the risk of being redundant, repeat a list of 10 websites hosted by two ISPs controlled by Texas-based SoftLayer.com that can be taken down with ONE SINGLE TAKEDOWN NOTICE:

Does anyone here believe HAN has actually made any attempt to stop these baitpaper sites? He changed the subject before getting to the part about proving that HAN has issued even ONE SINGLE TAKEDOWN NOTICE.

His performance as a "contributor" to ELI was all about deception, seduction and sedition. He and Tylor have built themselves a system of "plausible deniability". At the end of the day, it's just a house of cards and the wind is starting to blow in Honolulu as the heat rises.

Notice how I did not call them a thief, yet in their letters, they don't seem to hold back judgement..See thats the difference between them and us, we try to do things the "right" way, albeit our methods may not be mainstream..

I guess I'll have to make a note to clarify this in the next video update..I mean if someone were to message me that Copyright Services International were resorting to text messaging demands, but they didn't want to share them, I would certainly share the this new development, no harm no foul..as far as I'm concerned.

Good point SG, I'll see if i can clarify "my" position, I won't speak for Matthew.

If information is sent to me I will always obtain permission to openly share it, whether it be in our scribd library or on the forums. and any personal information will ALWAYS be redacted. If that same information is shared with me, and I don't have permission to share it I won't, BUT I may choose to report on it. Yes the documents themselves would not be posted, but I may make reference in a post that there is a new development, involving such and such, law firm / troll making phone calls for example.

I guess what I'm getting at here, is I don't want folks dangling carrots under my nose, you all know I can be like a dog with a bone at times..

you'd be using the same if you downloaded the files via FTP, the files size is the file size. I'm not clear on why you are "downloading" them anyway, just watch them via oovoo or youtube?? or is your provider hitting you for bandwidth as well?

Isn't it interesting that how through two sets of eyes, we look at the cases in very different lights and focus on different things?

In this narrow instance, Carolyn and I do agree that the web developers are no longer off the hook anymore as we previously thought. Nevertheless, as a practical matter, copyright infringement lawsuits in small cases are still very much a waste of time and a huge expense. It is almost always a net loss.  A "paper win" but ultimately a "financial loss".

This letter also opens up a new line for us to research: the state laws relating to "theft by deception" or obtaining property or money by "false pretenses."

It appears to me that Getty and McCormack seem guilty of this, but I'd like to hear what some of the rest of you think.

A couple of quick notes to add..

This was just a referenced case on the photoattorney.com site, Carolyn was not involved in this case, nor does she state this..She or Leslie Burns whom assisted with the article did however pick a really bad example, certainly not a "win" I would be bragging about, and I would venture to guess Corbis would like like to see anymore of these "wins"..

Now onto the web designers and developers, and I'll speak for myself here, but I find that even educating and "providing a warning" generally falls on deaf ears although I try my best to give them fair warning. I have all of my clients supply any images to be used with the exception of layout elements, that I may create from scratch, if they don't supply me images, they get no images, it's as simple as that. I also go the extra step in my contracts to state that my clients will hold harmless my company should any issues arise. I'm considering requiring clients to supply me with license / reciept copies to keep on file, so I know they have obtained images properly, but at this point I think it would be overkill.. Bottom line is today's web developers need to change with the current environment, to be proactive in not just protecting themselves, but also in educating their client base to the best of their abilities.. Something the stock photo industry refuses to do. Besides these forums I find myself discussing this issue almost on a daily basis, and if I was confident in my public speaking abilities I would go so far as Jerry ( McFilms) and address meet-ups and groups in the area. I would hope that most if not all legitimate web designers/developers are already aware of these issues, but we'll always have the fly-by-nighters and side businesses that won't know any better..

There is a lot of information here and I will be going back and re-reading it again to take it all in but this was indeed a very costly win for Corbis.
 It is also very interesting that they found they web designer partly liable especially since it was not proven who provided the images as each blamed the other.  Perhaps web designers should start providing a warning about copyright infringement and the dangers of the so called “free” images and not using anything unless you created the image or got it from a government site where the images are copyright free.

Matthew once again hit the nail on the head; while Carolyn E. Wright can say that this was a win for her, I’m not sure how current or potential clients would feel about her abilities if they knew the win ended up costing her client (Corbis) a 127k.
