They most likely won't say anything, just send it back to Getty as required by law. I personally would have kept it to the bare minimum that is required and outlined by the FDCP

Good Point SG, we'll have more on this later today, I'm already doing some rooting around...

Just a quick thought.  Correct me if I'm wrong here.

"Company A" owns the image, and you've allegedly infringed upon that copyrighted image.
Next, "Company B" assumes copyright ownership of the image, and now they're coming after you?

Could it be that the alleged infringement was with "Company A", and "Company B" wasn't damaged by the infringement, and cannot collect damages?

Let me clarify my statements.  I stated that photo attorney Carolyn Wright was well respected in the photography world, this isn't to say that she is not a troll of epic proportions, IMO she is. It's kind of like stating that Getty images is the worldwide leader of licensing images,, whilst at the same time they are also known as the largest copyright trolling business in existence.

Actually, after I finished the last post I thought I would just go ahead and share the letter I sent.  Perhaps someone who just got a letter can use it as a reference to help them if they choose to respond to GI. 

 Okay, I think I need your help BuddhaPi.  Is there a way to insert a word doc here so that it keeps its formatting?  I will post the letter once I figure out how.

No way to do that, that i'm aware of, you'll probably lose the formatting..sorry i'm not to helpful today..

what they are doing is within the law, just unethical and sleazy..get ahead of this, and get with your client, at the very least you don't want to make them angry...

It would appear they are unwilling to negotiate any further.
Has anyone ever considered a criminal extortion charge against them? Opinions and advice would be most welcomed.

no disrespect meant for David Fewer, but I would take all of this with a grain of salt, doesn't much matter what the law "states", fact of the matter is that Getty will most likely NOT file suit over 1 image. There are ways of fighting this besides the "legal" way.. Getty knows this, they've been playing the game for a long time, and it's strictly a numbers game to them..

Chances are good, they will now cut you out of the equation and approach your client, and probably take back the "reduced" amount as well. You need to be pro-active here and sit down with your client, explain the situation, refer them here, and hope you can salvage the relationship you have with this client.

If you've done other work for other clients, you'd better be going thru those files, as it is likely they will get letters as well, which could ultimately put you out of business, or at the very least leave you with less than a stellar reputation.

why make it easier on them to extract your money? let them purchase paper and stamps and go thru the motions, why make it easier on them? I would promptly cut off any telephone, email communications..
