I also liked Oscar's mention of the "cringe factor." Being aware of this will help me be more mindful of what I write on the days when a full head of steam has worked up to blow off level.

Sorry but I'm going to disagree with this, every time I see one of these absurd letters I cringe and my eye twitches, I will continue to fire back to whomever is involved, while at the same time keeping everything as factual as possible, or at the very least being able to back up what I post..

Damn! I feel extra special this morning!  ;D

Great interview!

Lets not be subtle here or anything...

Maybe "someone" (RK?) could call Texas Comptroller's office and find out if Getty Images actually pays in sales tax. Or see if Getty Images has a Certificate of Good Standing in regards to state tax collections.  Is Getty Images, in fact, truly collecting sales tax or not?

Now that SG mentions t,I too remember seeing the VAT on letters from overseas.

uh-oh, I think someone is peeved!! Nice research Lucy! That pretty much shots this one in the foot!

Ya...are you kidding me with the sales tax?

I just looked up the artists name at the Copyright Office. There is only ONE listing for this photographer and it's not the image shown. (nothing new)

Also....$1225.00 for ONE image??? Plaaaaeeeez!

Well their site does not include a location in Texas. I bet the State AG of both Texas and Washington would like to hear about this..sales tax on a "CLAIM"...I guess we'll never see it all!

I have, I can't find a definitive answer for what to do. Some people say ignore, some say settle out of court and some say contact them. This is really causing quite a bit of distress now.

You can't find a definitive answer, because there is none, it's a choice you have to make on how to deal with it, based on the suggestions here, every case is different as are peoples personalities.. Unfortunately not many of here are up to speed on the laws in the UK and we've not had anyone willing to really step up to the plate to help you folks.

What your missing is that Getty Images licenses images for all types of uses, be it web, print, video, etc..regardless of what you tell them the reply will be the same.. "pay us".

This is completely different, I wouldn't do anything until we get more feedback on this, my first thought is a complaint to the Attorney General, BBB, and anybody else we can think of, this is completely un-reasonable. Are there any names, beside "copyright compliance team"??

HaHaHa, Matthew has been chomping at the bit to use that word for months now..So fitting

That's exactly why I posed these questions, before I get all worked up for nothing..how the hell did they get your employer information??

They contacted your employer?? who specifically did this? how did they get this information. It's certainly unethical at best! This has me fired up! I'll address more in depth once you answer these questions, and I will also respond to your questions about your hosting company, but at the moment i'm floored by this seemingly new twist on things. ???

sit back and wait, sometimes getty may contact Oscar, sometimes not, each case is different. If something develops your attorney would contact you. Once Oscar sends the letter no one from Getty or associated with Getty can contact you.

What usually happens after the first defense letter from Oscar is sent out to Getty?

@doggycase, the statute of limitations can generally be "guessed" by the first date of the first letter, granted they found the image before they sent the letter, so this is a safe bet.. Now the Phillipines may be a different story, it may not be 3 years there, and I don't think the Defense Letter Program, would apply to you being your overseas..you need to research the copyright law of your country first and foremost and go from there.
