@ Lucia, I completely understand your position and frankly I could care less about his political views, opinions or his letter tho the editor, nor do I expect him to address them here. I can see how Moe has tied the 2 together, but i'd prefer to keep on the topic of the extortion demand letters and now phone call that Copyright Services International send out/make..

In regards to name calling, I've been very well behaved in that respect, yes I labeled Photographer Vincent K. Tylor, Glen Carner, Hawaiian Art Network and Copyright Services International "copyright troll", but I look at it as more of a "title" than a name. If he addresses my questions, fine, if not that's also fine by me, it only hurts his credibility more, if thats even possible at this point.

It's really very simple why Glen Carner only chooses to engage in certain topics IMHO. He is only striving to make his newly renamed company Copyright Services International, Hawaiian Art Network, and his own name look good, all three have been taking a beating here on ELI and he is trying to save face and keep sinking ships afloat.. It's completely coming from a PR perspective (which I might ad is not working out to well...again my opinion).

At the risk of being accused of being a FOG (Friend of Glen), I can see why he doesn't want to engage the topic Moe introduced. It's not about copyright, collections/extortion or anything else.

Anyway, on the topic itself: I don't see anything wrong with Glen writing a letter to the editor to support a particular political initiative in Hawaii.

Since Glen Carner doesn't like the term "Copyright Troll", much like the lawyers don't like the term "Extortion Letter" I thought I would paste this from wikipedia..

A copyright troll is a pejorative term for a party that enforces copyrights it owns for purposes of making money through litigation, in a manner considered unduly aggressive or opportunistic, generally without producing or licensing the works it owns for paid distribution. Critics object to the activity because they believe it does not encourage the production of creative works, instead it makes money from the inequities and unintended consequences of high statutory damages provisions in copyright laws intended to encourage creation of such works.

I think we have seen this phrased around before, but haven't had a chance to use it just yet, but I think it's only a matter of time before we can..

Vexatious litigation - is legal action which is brought, regardless of its merits, solely to harass or subdue an adversary. It may take the form of a primary frivolous lawsuit or may be the repetitive, burdensome, and unwarranted filing of meritless motions in a matter which is otherwise a meritorious cause of action. Filing vexatious litigation is considered an abuse of the judicial process and may result in sanctions against the offender.

I read through BuddhaPi's initial post twice. It certainly has a "snarky attitude" with sarcasm and innuendo but I don't see where he has actually called you anything.

If you think anyone is going to sanitize their writing for you, forget it.  People don't even sanitize their writings for me! Nearly everyone has strong positions they take on this topic.

If you don't want to answer, you obviously don't have to but let me clue you in, if you think BuddhaPi is going to rewrite his questions to suit you, good luck on that.

The reality is BuddhaPi's questions reflect many other people's questions. It is immaterial to me whether you answer or not (or stay or go for that matter) as your credibility is suspect with me and a number of other people.  However, others may want to hear what you have to say regardless.

He's referring to the fact the I titled the post " MY questions for copyright troll Copyright Services International & Glen Carner"

and no I won't re-write, rephrase, soften, sanitize anything I write, it is what it is, I call it as I see it, when I see if differently I will adjust to the times..I must admit I do like "Copyright Nazi as much as I like the troll moniker..

okay, so take the "free screen saver" out of the equation, there are still literally hundreds of sites with FREE high resolution images available for download, some even having a creative commons license..You don't need our help to damage your company, you and your lawyers are doing just fine by themselves.We simply report on goings on..

Seems Glen Carner has missed a few of my questions, or has just plainly chosen to ignore them. Maybe he doesn't like me for some reason, which is to bad cause I'm a really nice guy, so it's his loss..

Some of these questions are really easy to answer, just a simple yes or no would be sufficient, it may be difficult for Glen to do this without talking out the side of his mouth, or putting a spin on them, but we'll see..

Let me ask you this: Every letter except one we have seen come from HAN has been in regards to Tylors' images, why is it that none of your other photographers under the HAN umbrella have this very same issue?

While on the subject of HAN and the photgrpahers you work with, I noticed a few months back you had a nice listing of photographers under the Hawaiian Art Network umbrella, yet today when I look I see no list just V.K.Tylor, did your other photogs abandon ship, before the lifeboats filled up?

DMCA Takedowns...How's that working out for you, as we see there are multiple sites which still host VK Tylors' images, many of which are hosted in the states I don't suppose you'd care to share these notices would you?

Or did you the client not recieve a copy of this communication??

You send your letters in the hope you will make a quick buck, if that fails you escalate this to your attorney, thus instilling more fear and again hoping to make a fast buck, all the while threatening a lawsuit. In the event a suit is filed are you going to tell us that you really want that suit to go the distance?

I find it hard to believe that:  that you are not copied on this correspondence, where you could quickly and easily address items that were over the top..Do you indeed never see the letters that are sent?

While it is certainly great to see the ELI community so willing to share and pose questions to Glen Carner as well as offer FREE advise as to what he should change, I think it's a bit much to hand him stuff on a silver platter. I'm referring to links that point to accounts with his name on it, free wall paper sites with Tylor images.. After all he does have a "trained researcher" on staff, I think we should do our part to help the economy while at the same time giving the "researcher" some job security. If Glen and his "team" at Copyright Services International LLC are to lazy, ignorant or just plain dumb to figure this out on their own so be it.

I'm not by any means telling anyone what or what not to post, these are just MY thoughts on the matter...

I'm around Peeved. It just seems that there is already a whole lotta blood in the water already and I don't really want to add my chum bucket-full to the mix.

I'll be researching this for sure, but right off the bat, if you're number is on the do not call list, the collection caller could be reported, as this would be an unsolicited call, and being that the "callee" does not do business with the offending company, that makes it that much better..There are penalties to companies whomdo not follow the rules.. Like I said I'll be researching this and supplying links in the next day or so..

An email/phone call would have been much better than the threat of criminal prosecution & up to 5 years in jail.

Rest assured if the phone call doesn't work, there would be an "escalation", don't think for a minute that Copyright Services International, would accept an answer of "I'm sorry I don't have any money, my business is slow, yada, yada, yada" or would they accept a refusal to pay, the "highly trained collection specialist" would just put it in the stack to forward to one of picscouts "retail lawyers"..

The idea behind the phone call / email is to not make it a fight but to attempt an amicable resolution before the issue of copyright is ever even mentioned.  I think you guys have become so entrenched in fighting back that you never considered that there may not need to be one in the first place.

yeah, just call or email, get the credit card number, make some quick cash to pay the "collection specialist"...no muss no fuss, no fight.....Business as usual target the low hanging fruit some will always roll over and pay..some will not, and others will fight back...
