That is indeed a much lower amount, I hope my previous post did not come off sounding as being to harsh, so my apologies if it did.

I'm not clear on the what Getty was demanding from gettyouty, as I don't see the actual number mentioned..either way I still would have shoved Kliens video in their faces

I'll start at the top "Well Represented" and "efficient organization", I think we need to look at the Advernet case here.

"Wojtczak testified that the Getty Images Contributor Agreement did “not have signatures. It is a digitally accepted agreement. The contributor signed via our online contributor contract portal.” The following ensued:

THE COURT: And where, if anywhere, does a representative form Getty execute, sign the document, digitally or otherwise?

THE WITNESS: You know, I'm not entirely familiar with where in the process that happens"..... OOPS! so much for "well represented and efficient organization"

"extracting damages" - I find it amusing that Timothy B. McCormack doesn't like us using the term "extortion" yet he states that Getty and their copyright trolls are efficient at "extracting damages...So here's our English lesson for the day.. from thesaurus.com:

Yes they "know copyright law inside and out", simply because they are mostly college interns, who drink the company kool-aid and are very efficient at reading from a canned script..same lines of BS different "clerks"

"Professional and easy to work with" - let us refer back to one of Timothy b McCormacks' letter for a minute....

"You have copied and used these images without a valid license."
"YOUR COMPANY HAS COMMITTED COPYRIGHT INFRINGEMENT"
"your comapny is a direct infringer...."
"this agreement shall be kept in confidence by the parties."
"Why Your Company's actions are illegal"
"... your company, its officers, and other individuals involved in the infringement are liable..."

Looks professional to me! And he wonders why someone would entertain filing a complaint with the Washington State Bar Association?

Quick update, i sent them reply explaining the situation, no money was made etc (which is totally true).

but after rewriting the letter a few times i couldnt seem to finish it with a decent "so this is what i want to do".. In the end i offered them 20% of there orignal price. Which they accepted, I must say soon as i recieved the reply i did think "DAMIT I SHOULD OF OFFERD THEM 1% or NOTHING AT ALL" but i am still alot better off than i was 2 weeks ago, and have a big weight of my shoulders

Fact is, i offered what i was happy to accept OBVIOUSLY i would of prefered ZERO but i just wanted it over and done with..

As long as you're happy with the outcome, knowing that you got raped, and gave them another "win", and have probably been required to sign a confidentiality agreement to boot..not the preferred outcome, but like you said, it's now off your back.

I believe in playing fair and giving credit where credit is due, since Georgia Attorney Cindy Wan-Hsin Hsu is the person that signed off on that absurd extortion demand letter, I feel that it is only the right thing to do, to give her a thread just for her..special demand letter deserve special attention, even more so when said attorney has very little online presence. I am more than happy to help her get some attention in the field of "practicing law"!

Our newest copyright troll Garden World Images who now has the distinction of being part of the single largest extortion demand by retaining Photo Attorney Carolyn Wrights office along with Georgia Attorney Cindy Wan-Hsin Hsu formerly of the Coca-Cola Company, is also associated with John E. Grant III from the Meltzer-Grant law firm ( formerly IMUA Legal Advisors ) A lawsuit was recently filed by John E. Grant representing Garden World Images LTD against CLARITY CONNECT, INC., a North Carolina corporation, and TIMOTHY HOWARD.

I can only imagine the amount involved here as it is regarding 218 images..which is obviously different from what we generally see here. As much as these trolls are ass-hats, I have to say that Timothy Howard is not the sharpest knife in the drawer, it's one thing to mistakenly use an image, but it's completely different when one uses over 200 images, when the defendant is providing marketing services—including custom website design, logo design, print materials, and horticultural marketing—to clients..

I'm reminded of the line from Shawshank's warden "I see you two all the time, you're thick as thieves"

I will be forwarding the complaint to Matthew to add to our document library..another Pacer contribution..

Being as how greedy she seems to be, I would think she would take this case herself, so she doesn't have to share any "winnings",but instead she has decided to pawn it on a new disposable attorney, whom apparently doesn't know what shes getting into, or what lies ahead..Then again Photo Attorney Carolyn Wright probably realizes this is a lost cause and any judge would find this obscene on every level..
