Agreed, they could have licensed it from Getty, or they may have done exactly what you did, grabbed it from another site, that may have licensed it, which makes 2 infringements..and if i wanted to play devils' advocate I could say for example that the image you used doestn't belong to getty, and you used it, it's still infringement somewhere..copyright is created upon the time the image is created.. I see so many fall into this, people say "well xxx company gave me permission to use it.." or "there was no watermark or cute little c symbol" "it did not say copyright in the google image search"..etc...bottom line if you did not create the image, someone somewhere owns it...

Well said Simpson, a little education can go a long way. It looks as if this case has been escalated to the collection agency at this point. I think as a first move, I would sugest reading up on the Fair Debt Collection act ( also a sticky post) to first get NCS off his back, then go from there. It is simple to get it tossed back to Getty's desk provided you follow the instructions to refute the "claim"

A quick search of "Farolatino" revealed some chatter on some forums in regards to them wanting to take over ones video channel, seems to be something automated, so I doubt the video will be removed as I have disputed the claim and have followed up with you-tube, referencing other issues with "Farolatino"

I think it may be because of the music, which was an option provided by the google tool itself, I have quickly disputed this claim, and have claimed fair use, as this video does not generate revenue and is only used for reporting / educational purposes. We'll see where it goes, if anywhere..

It's refreshing when newcomers "Get it" right out of the gate! and thanx for the mental image of the kid pouting with it's arm crossed..might have to work something up.

I realized that when I read it in the letter and got a pretty good chuckle out of it.  When I read this reply to my request for proof why I owe this money, in my minds eye I could see the Getty rep crossing their arms and stamping their foot and saying "Cuz" like a little kid.  Think I might go and take a picture of the Getty building and put it on my website.  Then send them an invoice for rent on the building and say if you require proof that the building is mine and you owe me just checkout this link and you'll see the picture of the building on my site, that's all the proof you need now pay your invoice before we have to escalate this.     

The problem with their response is very simple, just because it's on their site means nothing, nada, zilch!. we've already had one user that contacted the artist, and the artist was no longer doing business with Getty, yet Getty tried to extort money from this hapless victim. They continue to state they will show proof at discovery, which just means they have no proof and they are hoping to just get paid..

and to add to this, most of those that are registered were done so in bulk, as in a compilation, which apparently has it's own set of issues. Also just because Getty may work "exclusively" with an artist , doesn't always mean the have the "right to sue"..refer to the righthaven fiasco and see how far they went.
