I'm not sure but I think Matt was interested in whether the "naked shots" were copyrighted or not.  Something about a project that might embarass our favorite Washington state attorney.  Or was that my idea ????

I like vijay jay, but I think that was copyrighted by the show "two and a half men"

Robert, I can't wait!

This should make Timmy cringe and re-ignite the fires under all the meme'rs out there.

The appeal was struck down because the photo was posted on the mayor’s public website where it can be viewed and downloaded for free after Kienitz licensed the photo to Soglin without compensation, according to the 7th Circuit opinion.

Interesting observation!  You may be on to something there Lucia.

I suggest you treat them like jungle animals.  If you show fear, they will not relent.  If you show that you are willing to inflict harm on them, they may back off and chase easier prey.

But, above all, what Lucia says is true.  You need conviction in whatever approach you choose to take.

Good advice Robert and Lucia!

Odds are they will NOT sue you.  They only sue a small, hand picked fraction of those they threaten to sue.  The economics of filing a lawsuit for such a small settlement just don't work in their favor.

Their confidentiality statements are designed to keep them in business.  They want to keep their trolling activities quiet.  We want to make their trolling activities public, so the ensuing outrage might get lawmakers to put a stop to their activity.

Get educated.  Read what you can in the forum.  Share what you know when you are comfortable.

In my observation, Getty's m.o. has been to not let go when they have a fish on the line regardless of what the fish tells them.

I encourage you to shar your link on this board and with Attorney Rothman who is doing his part to attempt t change Getty's behavior.

I agree with you Mulligan.  And I too hope the attorneys at Schneider Rothman IP Law do not allow themselves to be bought off.  This case could provide a huge service to people around the globe.

Looks like life is getting interesting for Oscar.  I hope he knows he has my full support in this effort.

Does sound a lot like bee's nest poking to me.

What Matthew says makes sense to me.  Not all extortionists are alike.  You have to know who you are dealing with.  Also good to know if the image is registered.  That can give you an idea of how much they might try to go after in a suit.

Your best bet is to review all images and remove any that you are unsure of.  With the technology out there today, if you have more offending images, they will find you.

I know that it means leaving holes in your old blog posts, but most of those have served their purpose and are (hopefully) unlikely to be re-visited.

Rule of thumb:  If it is not an image you took, and you do not have a license to use it, remove it.

So, it looks like, if Getty loses this suit, their business is done, finit, kaput.

But how will digital image content providers earn a living?

If I were in your shoes, I would ignore the email and get educated through this forum.  Email is not an accepted form of business communication.  I would expect that they will follow up shortly with a letter to the same affect.  I would hang on to the email, as it is your earliest notice of their discovery and hence the date your Statute of Limitations begins.

Learn all you can.  For now, the email might be a way to learn more about your situation.  Don't help them.  Get educated.  There are lots of options.  Don't make an emotional choice.  Learn a bit about the law.  Learn a bit about those coming after you.  And then decide how you want to proceed.  This web site is a great tool, if you choose to put it to use.
