Don't take me literally on the $10K.  It was just a number I chose to illustrate it will NOT be $100K or any other crazy number.  $10K is still a crazy high number that was arbitrarily chosen as a possible worst case real number given minimal or no defenses.

My itch to do an update video is growing.  I predict there will be one sometime in July.  We will see.  I am sort of letting things build up based on what I am hearing from people.

Good discussion all.  Lots of great insights and perspectives being shared.

First, there is the the theoretical discussion of what "should" be vs. what is actually practical and what can happen.

Getty, for all my criticisms about them, are still somewhat smart about this. They have created this little money-making machine and have made a ton of money without the PR exposure Righthaven attracted.

I hypothesize that there are multiple reasons why Getty hasn't fired off lawsuits yet. 

First, the obvious escalation would bring in folks like EFF and more defense attorneys into the fray. If they think Oscar has been a thorn in their side, can you imagine more defense attorneys jumping in like what happened with Righthaven?

Second, no matter what the companies may have you believe, there is no sure thing in court. You never know what the other side will bring. Being a larger company, in many ways, they have more to lose than one case.  Righthaven has shown that the occasional loss and bad karma can be very devastating. One loss for Getty Images for whatever reason would be very damaging to them.

Third, the actual cost and recovery would be low going after most of the letter recipients. It is difficult to believe that a judge would give Getty Images any more than $10,000 including legal fees for most single-image infringers. And assuming they got the judgment, how easily would it be to collect?

Fourth, sending threats and actually pulling the trigger would actually help expose the names of the employees and individuals involved. Corporate employees are notoriously cowardly and only care about their jobs and their salary.  I know this and this is why I look very hard for WHO makes and executes the decisions of a company.  They can say Getty Images all day long but ultimately it is the individuals who is responsible.

For example, Steve Gibson thought he was so smart.  But he is probably one of the most hated men in the biz today. That hatred will and continue to manifest itself in strange ways. Already, the anonymous strangers have created a mindshare on the Internet to join forces against him, Stephens Media, and what he represents.  Yes, there is some paid effort being expended but there are a ton of energy and time being expended to "get them".  Be very careful of those people who decide to take up a cause for its own sake and not for the money.

I could go on with other esoteric reasons but I am convinced that these intangibles would manifest itself in a real way.

Having said all that, the diversity of letter recipients and their individual responses/reactions are very different. As SG pointed out, there is not yet anything tangible to defend, simply the possibility of a lawsuit. But to defend against that possibility comes having a spine, some diligence, and a lot of learning.

Ultimately, you cannot always "convince" someone to see your way. Sometimes you simply part ways to agree to disagree. And I believe that happens very often from people who don't bow to the letters.

Anyhow, I am rambling but I feel better now.  :)

It would seem they are modifying their prices AFTER they determine there might be an alleged infringement. If that is the case, it adds further fuel to the fire that GI is manipulating the facts. If this ever came out substantiated in court, it would be VERY damaging to them. But having said that, most letter recipients don't have the wherewithal or skills to prepare the case and stand up in court without help from an attorney.

Wow, I just rechecked the image allegedly infringed upon and noticed with astonishment that it's license price went up from $49 per three month to $480!!!  Anybody is seeing thing with their images? Too bad I did not print the old price out to use as an argument.

Although you come from the Philippines, the issue is similar. The letters are mostly a threat. There is always the possibility they could take action against you. However, even if they win, they may not collect anything.  Almost everything we have covered for the U.S. can apply to other situations.  People need to understand that there is a difference between a threat vs. an actual meaningful action. Statistically, speaking (unless you have done something very noticeable), most people have less than 1% chance of actually experiencing a lawsuit. Most people just get emotionally worn down by the letters.

There are no surefire answers. As always, it comes down to your risk tolerance level, your assessment, and how committed you are to defending yourself. I already wrote about this in a sticky post.  If people are going to get an ulcer about this, it really doesn't matter what anyone says.  Go pay and settle and get it out of your life.

However, there is a good portion of people who are committed to fighting this with some intelligence and strategy because they are angry and think this is plain wrong. I fall into this group of people. I respect lawsuits but I don't fear them because it isn't quite so easy to win and collect money. I have said this many times. But that is only my experience and judgment.

There is another group who scare easily and don't have the ability to be look at this objectively. They will have an ulcer because they need finality and a "sure thing".  And the majority of people are somewhere in the middle.

I know what I would do but I cannot tell people what they should do. The question now is do you believe them? And what do you believe the consequences are?

You have to understand that the few frontline people you interact with are legal students that have to adhere to the party line. They are in no position or empowered to get into deeper discussions. They are simply trained to respond with the party line. They often resort to form letters which is what is happening with you. They might sprinkle in some customized responses but don't be surprised if they don't deviate much. Even if they wanted to do more, I believe that GI won't let them especially if they want to keep their jobs.  Anything they may feel personally, has to be kept behind closed doors.

In fact, I believe there is a healthy amount of turnover in the License Compliance Dept. I think there is a personal toll that the job takes over time.  I cannot prove this but that is my gut reaction in watching this over the past 3 years. In fact, over time, they have outsourced more of the responsibilities that was done internally before. They have slowly and gradually shifted more of the front line communication to other law firms and collection agencies. They are doing so to protect middle management by not exposing them to upset letter recipients.

Thanks for doing your homework on Masterfile using our forums. It makes life easier.

You can simply write a letter to Masterfile that you intend to hire Oscar as your attorney. As long as you do that, I think Masterfile will comply and go through Oscar as you are waiting for him to take your case.

Don't jump the gun yet. WHO is the attorney and law firm?

As I have repeatedly said, getting educated is key.  There are free videos/audios and many forums posts.  Filing a lawsuit and actually winning and collecting on it are very different things.

If you can't afford it, you need to get educated on all the issues before you give yourself unnecessary stress.

The other option is to spend $195 and hire Oscar. I don't know your attorney but exactly how well versed is your attorney in this matter?

It never hurts to try. However, other web designers have tried to accept responsibility on their clients behalf with little success.  Essentially, they are trying to punish the website owner. And if the website owner wants recourse, they go after the web designer.

What might make your friend/client happy is if you offered to hire Oscar on their behalf.  The letters will then absolutely stop. Essentially, you pay the legal fee for your client. Your client will ultimately be in control but if they give you permission to Oscar to be "in the loop", you will have more control over it than you do now.

As of now, you get the privilege of painfully watching your friend get harassed. You will have to decide if $195 is worth it or not for you.

That was one possible strategy that I had planned to use but never got around to it. I wanted to find out the photographer's position on it and I did find him but never got further than that. There is no harm in trying to find out. It shows you cared enough to make an effort.

Wayback machine have noble intents but I think potentially, yes you could be sued for it.  But then again, I could sue you for no reason either.  People keep forgetting that people can be sued for anything for any reason.

But yes, they will delete every website presence you ask them to. However, domaintools is a for-profit that does the same thing.  In fact, I believe Getty/or one of the stock photo companies already use them as a backup to Wayback machine.

I think this case was ultimately dropped because of the embarrassment of suing a journalist but it does show how many stupid mistakes Righthaven continues to make.
