I could not agree with MC more on the point of stepping out of the shadows and being vocal about these letters, by rolling over and paying or staying silent, just helps fuel the furnace and the more will get burned!

There are some compelling points to this response. Not only do I find it utterly amazing that Getty Images would go after one of their "approved contributors" and apparently a long time customer, I also find it appalling that they can even think they can demand 700.00+ for an image of a sprinkler head! and to boot an image that they seem to have 100's of available as royalty free images. Any judge would have to be blind as a bat to not see this image as being worth next to nothing, Rights managed or not.

I predict that will be included in the next letter, "this is a rights managed" images therefore it is worth more..what a croc!

It's completely your choice, but I can tellyou that going back and forth with Timothy McCormack the copyright troll won't get you anywhere, they just want your money. They have no case, they know this, they just want to wear you down. You need to fight this on your terms, not theirs! They can only get actual damages if they file suit, win that suit, and are then awarded damages.. as it stands right now it is a claim and only a claim..

go-daddy's website tonight is pretty much useless for just about anything, but do send the request to archive.org, unfortunately with the go-daddy thing, you won't be able to prevent picscout from knocking on your door and gaining access, or any of the other"bad bots" that are out there trolling around..

Did you search at archive.org and domain tools? If the site came down in 06, there is no way they could have a screen shot, someone somewhere is not being truthful...

If you removed the image from your page and the images folder, there is no need to contact go-daddy, as you've already removed it.. Archive.org, caches webpages and it's easy to remove your cached version of the site, use the search tool above for archive.org, one of the threads here has the instructions.

Picscout is the software they use to hammer your server and search for images, it then compares images found within your site to their library.. Getty Images owns Picscout, and most of their own competition is using it..

It's also worth noting how in Mr Rob Cooks letter he basically finds the recipient guilty by stating "As a result of this confirmed infringement..."

Where is the proof backing up this statement: "Superstocks' business has been injured..."

I also like how they request insurance information, thinking this may be an easier way for them collect with any fight...

Actually was not able to find anything out of the ordinary in regards to Rob Cook the attorney working with Shutter Stock SuperStock, like the rest of the copyright trolling lawyers, he has very little online presence.. I like to look at my "research" as not only helping the ELI communitiy, but I'm also helping them get some exposure!  ;D


Rob Cook's law firm is your one stop shop for as it seems just about any area of litigation.. A regular "Jack of All Trades"! aka "Ambulance Chaser", and one of his ads "No Fees OR Costs, Unless Recovery Is Made"

Now this is just my opinion, but I would guess that the reason he's has jumped into copyright trolling is pretty simple and self evident, he has broken the "Law of Line Extension" which simply put is spreading oneself to thin and trying to specialize in to many area's whereas they all suffer the consequences..but I degress from the marketing lesson...Onward to the good stuff..

A quick Google Search yields very little online presence other than the standard listing pages ( which I don't find surprising, as he's just another unexperienced attorney in the Getty/Picscout stable.....This is strictly my opinion as I don't have a clue how much "experience" he has, but I feel I should clearly state this lest someones panties get in a knot)

I see there are only 68 connections, further backing up the no online presence to speak of theory, and also of interest it states:

Now if it were me and I was getting awards and honors I'd be sharing this with everybody and anybody, but maybe that just me and my ginormous ego, not to mention the fact that I cannot find a single case with his name or any experience listed anywhere...you'd think some of these "wards and honors" would be referenced somewhere on the internet..nope..

For some reason I always picture these big time heavy handed attorneys, working in these really nice offices on the top floor, with all of the plush interiors and furnishings, gilded artwork..I guess I can forget that image now.



I can only assume that Mr Rob Cook P.A. from St Augustine Florida has a valid license to be showing this image on his facebook page, afterall he is a copyright attorney and would most likely know about these types of things. Or maybe Shutter Stock SuperStock "comped him"

The second auction of Righthaven LLC assets, including its trademark and a copyright for a Las Vegas Review-Journal editorial, is scheduled to begin Monday morning on eBay.

It's also possible the buyer of the copyright assignment for the R-J editorial could demand that the R-J remove the editorial from its website or pay a licensing fee to post its own editorial.

That could put Stephens Media LLC, owner of the R-J, in the position of having to discredit the copyright assignment it earlier agreed to.

But doing so could contradict Righthaven's stance in pending appeals that the copyright assignments were valid.

Not to mention TechCrunch will probably keep the video up if it is generating traffic, who knows, maybe someone from TechCrunch will see the hits coming from ELI and eventually come here for a visit and maybe do a little story on our fight.

Linnea is absolutely correct. It's okay to keep a backup copy on your PC "just in case". But until the day TechCrunch takes the video down, we should use the TechCrunch video if at all possible.

This video will be a long-time classic for us. I was simply amazed when I first saw this video.

Just remember that the rights to that video belong to TechCrunch!    :D
