I think what most people don't realize or fail to think about, is the fact that time is money, Oscar has many more pressing issues on his plate than the Letter Program. Most people probably say to themselves, "I only need 5 minutes, whats the harm?" problem is that 5 minutes probably turns into 15 minutes, multiply that by say 20 calls, thats 5 HOURS of answering questions, that have most likely been addressed on these forums multiple times!

Making changes and streamlining this program is a step in the right direction and will not only better serve ELI, but will also better serve Oscar in the long run, so he can focus on his practice while at the same time remaining an integral part of ELI.

I have a feeling I will exceed my quota at pacer very quickly..

So this case noted below appears on Carolyn Wrights site as a "Representative Lawsuit"

Russell Huffman v. Marty Foutch, et al., 3:10-CV-02130-D (N.D. Tex) (represent plaintiff for copyright infringement claims)

However when I looked at the complaint her name does not appear..Now there is a chance I overlooked it, being that I'm looking at multiple cases..or shall I say EVERY case...wouldn't it be a bad practice to list something on your site, and have a completely different law firm shown as the plaintiffs attorney??

I've known for a long time that Carolyn Wright is well respected among photographers, and I also know why..she is a professional photographer herself, and as being one of the "family" as it were, she published the "Photographers Legal Guide" as well as offering form templates for photogrpahers.

She has also been associated with Hawaiian Art Network. I will be digging thru all cases that were filed, and report back any interesting tidbits.

As some of you may know back in Sept. 11 I had to issue a DMCA Takedown notice for someone that was infringing on my work, basically it was an ex client that had another company copy a site I developed, this copy appeared on 2 different domains, not only the site itself, but also any and all images that I shot myself (no stock images). as per our contract my company (me) retained all copyrights and nothing was transferred. They did make some minor changes, like phone number, and some meta-changes. They did however leave my copyright notice/credit on the bottom of the page, which helped with the takedown notice, there was absolutely no question. So I sent the takedown request and took a chapter from Matt's thinking, it was just the generic takedown, it also included screenshots, and a copy of the signed contract stating who owned what... After about a week the 2 sites were removed, probably because I called often...Fast forward to today... I just discovered that one of the site is back online, thos this time they did not swipe my design / coding, but they are using 2 of my images.. I'm debating on whether I should re-issue another takedown.. I'm leaning toward not bothering, yet this ex-client really pisssed me off and I just might have to be a ball buster....end of rant...

In what has become its trademark style, Las Vegas company Righthaven LLC is tardy again filing key court documents, and now it may face more penalties.

For reasons that haven’t been disclosed, Righthaven missed a Feb. 22 deadline to file its opening brief with the 10th U.S. Circuit Court of Appeals in Denver in the case of Leland Wolf and his It Makes Sense Blog.

Contact weebly, ask them if it is removed from the server, tell them the situation and that you were proactive and removed the image well before getty came along, they may offer to assist you with this, given that you don not have access to the server.

when the image was removed from the page was it also removed from the server?

What is the date of the Getty letter, is it before the date the image was removed or after?

If it's after I think you might be in good shape, as it shows you were pro-active. naturally getty won't care about this, as they have a screen shot..

All of your questions have been answered on the forum multiple times, keep reading the posts, and get educated as to your next step. there is no "magic answer". Bottom line is that they won't sue you for 1 image, but they will continue to be a pain in the ass.
