I can't speak for the link issue, but I can tell you that MF is a different beast than Getty Images, in a couple of ways..

They are more aggressive and file suit more often, but seldom over 1 image
They generally have their act together..ie registrations.

 I know Oscar has handled some MF cases, but the pricing structure is different that the standard 195.00 Getty Letter..

Thanks for the great advice.  I missed another image.

By the tone of your OP, it sounded like you were not very pro-active, in removing possibly infringing images. It's pretty simple really you either have a license for every image or you don't, for the ones you don't have a license for, they should have been removed.. as far as advice goes, there are literally 1000's of post here with advice, do some research, get some education, then feel free to ask any specific questions..Just because the sympathy may not be there doesn't mean you won't get help, but you have to do some of the lifting yourself..

Very interesting concept SG, the same scenario could also appy to a "royaly free" image, using your flyer example, say I create the flyer, and you post it on your site, they could easily send you a letter as you never purchased said royalty free image, and therefore have no "right" to have it on your site..

The statute starts to run when the images are discovered, generally you can start the clock from the date the first letter was sent to you..

I highly doubt Getty's images were ever in the "public domain", offered as royalty free, yes, but these are 2 different beasts altogether. I "think" once in the public domain it stays there, I don't rememebr exactly how long a copyright exists before expiring, but I want to say like 75 years..

97 Las Vegas Karaoke Locations Sued By ‘Righthaven Of Trademarks’ Demanding $500 Million

Steve Green, who was the absolute best reporter covering the Righthaven saga, recently wrote about the fact that 97 Las Vegas karaoke providers were recently sued by a company called Slep-Tone Entertainment Corp., which apparently mainly does business as “Sound Choice,” selling various karaoke content — music and videos. Green notes that someone familiar with Slep-Tone has called it the “Righthaven of trademark infringement,” though there are clearly some differences.

Because removing the images from google or the wallpaper sites, would hurt the bottom line.. Who much can he be making by selling 5x7 prints for 10.00 a shot?

The part that got me was, their was an email where the photographer admitted to posting his images on free wall paper sites! Talk about damaging... I also looked into some of these sites and was able to confirm that they are hosted in the states... It does not appear to me IMHO that Mr. Carner or Vincent K Tylor are very honest...

I see Mr. Glen Carner from Hawaiian Art Network, lent his name to a letter at Copyright Compliance

I never knew he was a "photographer", I thought he owned some sort of gallery.. But then there have been some other irregularities with Glen Carners statements in the past, I suppose the truth lies somewhere in the middle...

Please be aware that "Royalty Free" does not mewan free, so many people get tripped up on this.. It's just a different pricing / usage scheme...Options to consider.

1. You yourself purchase the license for any images ( still risk of getting letter as SG points out.
2. Have your blogger "link to images/video ect.. still a risk of getting a letter, as we have a couple users dealing with this currently
3. Use images in the public domain, limited options, but there are sites listed in another thread.
4. Take your own images with your own camera.
5. Use zero images.

I currently my clients to supply me any images, I tell them to purchase, whether they do or not I don't follow up on, they generally sign a "hold harmless agreement, so if they get the letter, they cannot stick me with it.

I would try to steer GI toward your blogger you have the contract with, worst case as SG points out, if you end up paying Getty, you'd have to go after the blogger for the amount paid, probably in small claims court, being as you have a contract you should get the judgement, payment on the other hand is a different story..
