Robert, when you intend to quote something from any source, you should enclose the actual quoted text in quotation marks (""), to set it apart from anything you are writing, and to make clear to readers what exactly is being quoted.

Now I for one thought the quote was clear when you led with

Who is this Timothy B. McCormack you all keep talking about?

Are you referring to a blue movie porno star?

When I google that name, I see some odd images.  Does he really sell turd polish?  What's a copyright cow? I saw some homophobic comments.  Are all these the accomplishments of one fellow?  If so, I have some friends who might like to meet him.

But not if he's that guy from Seattle that allegedly represents Getty images that these forums keep talking about.

I am NOT a lawyer.  That said, if I were in your shoes I would ignore any contact from them.

My reasoning is simple.  If you did not receive the refund check, I would suspect that no such check was ever issued.  I don't believe half of what McCormack's people say.  BTW, the other half is also highly suspect.

I certainly doubt that they would ever come after you given your good faith effort to settle.

In addition, I don't believe Getty ever allows McCormack or anyone in his firm into a court of law on Getty's behalf.  They appear to work like a collections agency, masquerading as a law firm to instill fear in their targets, and paid strictly on commissions.  They would not like the fact that you paid Getty directly, cutting them out.

Perhaps some of the attorneys who monitor this site can comment.

I recommend you do NOT correspond with them via email and DO NOT speak to them by phone.  They don't know they have your email address until you respond to them.  If they get you on the phone, they will be trying to learn more about your situation and get you to admit something.

If you feel you must communicate with them, some do, do so only in writing and send things registered.  Admit to nothing.  Require them to prove that they are who they say they are and that they have the legal standing to negotiate.  Not communicating at all might be just as good of a solution.  Only you can decide what works for you.

To JLorimer's point:  If the letter shows an observation date of six months ago, that is when the Statute of Limitations begins.

Often, you will see quoted on this web site that the safest date to use as the start of the SOL is the first date of any letter you received.  That is the most conservative approach.  The DMCA says they have 3 years from their discovery of the statute.  If someone gave you evidence that they had discovered the infringement 6 months ago, you can certainly make a strong case that that is when the statute of limitations begins.

Getty and McCormack IP Law like to play the game of "If we don't hear from you, we will be forwarding this back to (the other party) and recommending legal action."  It's a great way to scare the crap out of someone.  And it must work because they keep doing it.

I, personnally wouldn't worry about it.  I think it is a scare tactic.  I am sure this has happened before.  Hopefully someone with Getty - NCS IP Solutions experience will chime in.

Just a word to the wise.  If you have filed a complaint, and you don't find it on the calendar, please let Greg know.  Sometimes the AG's office might file a complaint under a different code than the ones Greg had them search for.

If this list is incomplete, many of us want to know about it.
