Perhaps an alternative.

Questionable current statistics indicate there are approximately 30,000,000 bloggers in the U.S. Let's presume one-third are "serious" bloggers, this brings us to 10,000,000. Of these serious bloggers, let's presume 10% actually care about their rights, this brings us to 1,000,000.

What would happen if someone started a group of United States Bloggers United by Dollars, i.e. USBUD. Cool, now we have a group. What would happen if USBUD initiated a "pre-legal" program wherein members contribute $100 to a savings account, and that such contribution would be held in the account, overseen by a legal authority. Interestingly, this brings us to a total of $10,000,000.

What would happen if the mission of USBUD was to use that $10,000,000 to do one of two things?

1. Hire lobbyists to go to Capital Hill exercising the Malcolm X approach of making noise until people listen; or

2. Use the $10,000,000 to delver 1-5 really, really, really good legal battles to Getty/Piscout.

Americans have more power than they can imagine. Their problem is they're mostly living in a post-traumatic stress society of learned helplessness.

When you have a giant who goes around bullying millions of little people, it's time for the little people to band in numbers to create their own giant. Personally, I'd be happy to contribute $100 to such a cause.

Make arrangements that, if no lobbying or legal battle against the giant takes place, then everyone can get their $100 back, with about $1 in interest. Actually, this works to give us a niftier name, the Giant 101 Equalizer Group.

When you put together that much money for a cause, it's like "locking and loading." You don't have to fire - you simply have to show your teeth.

In terms of legal battles, I know $10M isn't too much. I would live to see $100M, then everything would boil down to a simple question. Would the giant like to spend $100M across multiple fronts?

This is a matter of tactics, and when people think about tactics long enough, they eventually come up with a very good plan.

If you send an email to them do you know that your email got through, did not end up in a spam folder etc.?  I sent all my correspondence to Getty out via certified letter, that way I had a signed receipt that it was delivered.  I also would only accept written communication from them, I wanted hard copies to take to court should they be foolish enough to go that route.

Very funny.  Why would you ever give these people the satisfaction of communicating any other way? Email is the ONLY form of business communication.

You can also look to image companies that do not participate in the settlement demand letter game and offer quality images at fair prices.  When I need to purchase an image I use Pond5.com.

As Matthew said, without knowing who you are dealing with it is very hard to tell you anything.

This forum is read by several of the copyright trolls.

All I can suggest if you do not wish to provide any information is to read through the forum, most answers can be found there.

Yes, it is Getty's Address, Getty owns Pic-Scout, so they would probably just use the people they already have rather than hiring more. 

It's just my opinion but after all the court defeats along with their costly victories, added to the drastically changing stock photo industry and finally picking on the wrong person I think the end is finally insight. They are probably starting to hurt for revenue, Robert has seen several Pic_Scout generated letters of late. 

The light at the end of the Getty/McCormack tunnel is a train....cue the music.

I couldn't find anything that I thought was actionable.  He doesn't cite any cases specifically, but seems to make up case stories to make his point.  I guess I can't make the case that he is lying, because nothing substantive is said.  Makes me ill.

Sounds like he could be a politician then if the trolling thing doesn't work out ;)

I thought the same thing myself when I read this, then I started thinking if it were actually the case I'm sure Oscar would have chimed in on the subject by now.

If we think about it when there have been occasions when Oscar has spoken up about settlement letters. A good example is the couple of times since I have been on ELI where Oscar has graciously given Mr. McCormack a heads up that he may wish to rethink the wording of his letters before it causes him problems. Interestingly enough each time Oscar made the suggestion Mr. McCormack made the changes.

I think everyone here on Eli will be following this case closely. Hopefully they will not back down and through the process of discovery we can get solid facts about Getty's business model.

Attorney Rothman says,

If that is true, why haven't we been able to get the Washington State Bar Association to pull Timmy McCormack and Lauren Kingston's licenses?

If Rothman can clue us in on how to properly make the request of the WSBA, maybe we can save a lot of people some big headaches henceforth.

I am willing to be a party to a joint lawsuit or any other formal civil remedy and I am willing to travel to other jurisdictions if need be. I am also willing to engage in publicity to raise such funds if necessary.  It is not a tact I would normally engage in or endorse because I distrust the legal system but it might be the only message they understand.

I too would be willing to join a suit against Getty.  As I stated in an earlier post I also have documents that may be of use.

You are missing the point of everyone trying to help you here.  it is one thing to warn people to be careful and avoid using an image but you need to take the image down if you have not done so already, regardless of the value....it's not yours.  ELI tells everyone if you didn't take the photo, license the photo or know for sure it's in the public domain then DON'T use it. There is a world of difference in taking an image down, then fighting the good fight as opposed to your approach.  Just saying.....

hahaha, his web host removed the image for him..along with the entire site. I completely understand that sometimes people will do say things that are way over the top in the heat of the moment...perhaps the OP will rethink his posisition and come to the conclusion, that paying a "few hundred" bucks to a photographer is not only the right thing to do, but would also be the smart thing to do.

Well, guess he had to pee on the electric fence after all  ::)
