It is my opinion that the article is not a balanced and fair portrayal of what happened and the issues before the court. It is important for everyone to realize that this ruling came down even though Matt Chan never met or called or went to the complainant's house. In fact, the complainant's regular referral of this as "cyber-stalking" in media accounts AFTER the order was issued reflects exactly what I am saying. This is not a cyber-stalking statute as Georgia courts have held that merely posting negative information about someone does not violate the statute.

Also, if you repeatedly threaten civil lawsuits seeking sanctions etc, but never file them (and had no intention of filing them when you made the initial demand) then how sincere and reasonable are your demands?

2. Negotiation of a fair settlement? - we used to but Getty will not come down to what we believe is a fair settlement, so no we just state our legal positions and ask them to tell us if we are wrong, they usually don't reply.
3. Other? Yes, once they get a letter from a lawyer, they cannot contact you directly and they usually move onto the fish that just cut them a check. Getty sends out thousands of letter each week and our letter program (while highly effective) has represented far less than 1% of letter recipients, so we are just a little gnat buzzing in their giant ear.

Do not engage them in any further conversation after that - while your specific issue may not have been discussed in a separate forum, it really isn't new as we have discussed hotlinking and and there is lots of info on the Getty program in general. Good luck!

It's nice to see that MF enjoys the ELI forums! I can't address the issues they raised in their reply to you because I am not admitted to practice in Canada but I do agree that I have not seen them filing much litigation in Canada anymore.

Also recall that McCormack has never to our knowledge filed an actual complaint in court on Getty's behalf - he has been challenged repeatedly on this site by me and others and has even recently changed his boilerplate trolling demand after we broke it down, so Getty going to McCormack does not change the scenario at all.
