If it was a mirrored site and the banner / image in question was pulled and served from there, what you have is an issue of hotlinking, and this is not a copyright infringement, telling them this and the fact that you do not own the domain in question, should make them go away. This is almost exactly what Lucia is dealing with. This is not something they will likely pursue once made aware of the facts...but then again they tend to not want to hear anything except for the cha-ching sound, so you may have to go around with them for a bit. Lucia drafted a very well written response to her situation, and I'm sure she will chime back in here..

The Associated Press is heading into court to defend its copyright, but its leaders swear they’re not on a crusade against aggregators. How the case evolves could pivot on how a court considers the site AP is suing — as a news clipping service or as a search engine.

Funny how this comes along right after the AP launched it's "NewsRight" and also stated they were not in this for litigation...

If memory serves, I think the stone collection was indeed sold as a set of CD's way back when, I think I had the complete set of them, it was  like a 12 -15 CD package, that I purchased at Best Buy or somewhere similar, many, many, many moons ago. I now regret getting rid of them, as the image in my case was also from the stone collection.

I wasn't suggesting to throw anybody under the bus by any means, just sorting out who was responsible. It's been reported on so may times here of web developers/designers that use unlicensed images, then leave their very own clients hanging with this problem, that it's sickening.

This is a bit different that in the past the letters generally got sent to the contact on the whois of the domain, unless it was a private registration, and this info was hidden. Then that would give them cause to use the addy on the site itself. The"guy" that registered the domain, did he use his name? did he put the image on the site? if so he's the responsible party, and you could respond stating that you do not own that domain, and that they need to look elsewhere.

Good discovery Lucia, I did a quick IP records search , and it leads back to a hosting company called voxel.net, doing another quick searck of Voxel.net + Picscout yieded some interesting results, that I am currently digging thru, however the below jumped right out at me immediately.

FYI - voxel.net is out of New York, which makes me wonder if Getty/PS have moved their operations from Israel, or if they are now operating both here and abroad..

@Peeved, I think the general response from getty when asked questions has always been, "we'll show the proof in court", which has always been an empty threat. I agree with making at least an initial contact, informing them the image has been removed and perhaps making an offer of good faith, as this would look good for you IF it goes to court.. I also like Mc's method of maddness, in making them work as hard as possible..all the while burning up time and effort..

Well if it has "always" been Getty's response to make the "empty threat" of "showing proof during the discovery process", then I feel even more strongly that you should "lawyer up" in order to make the letters stop entirely.

So again, you can lawyer up, or if your case is very strong you can go back and forth like Mcfilms & Lucia until you actually hear the words that they are "no longer pursuing the case" or, you can ignor all furthur correspondence which could be like Matt described as "Chinese water torture"........NO PROBLEM!
 

Perhaps I should rephrase, up until now it has been largely an empty threat, as they rarely file suit ( as it is now)..
