@Peeved, I think the general response from getty when asked questions has always been, "we'll show the proof in court", which has always been an empty threat. I agree with making at least an initial contact, informing them the image has been removed and perhaps making an offer of good faith, as this would look good for you IF it goes to court.. I also like Mc's method of maddness, in making them work as hard as possible..all the while burning up time and effort..

That's one of the great things about this forum! People taking different scenarios, thinking out of the box and sharing this with others. The more time that passes, more options are revealed, discussed, etc.. this all serves the greater purpose of educating the newcomers, so they are better armed to make their own decision on the best way to handle their own situations.

In my case I decided very early to hire Oscar rather than deal with these asshats at Getty, fast forward to today, and I would probably do it differently, now that I am much better armed.

well it's good they refused delivery!, It is probably an escalation notice, I doubt it would be any sort of judgement, as you were never "served" in the first place.

The 3 years is generally from the date of the original letter, it could be a bit sooner depending on how long they had it in their stack, so safely go by the date of the letter. At this point I would not do anything as they don't know where you are..

The artist Deborah Jaffe has a very hefty client list, which makes me wonder why she do do any business with a stock photo site, unless she only does RM images which are more costly..

Could not agree more. Lucia should NEVER have received such a demand in the first place regarding her case! She should also receive a sincere apology and compensation for her stress as far as I'm concerned......just sayin'

Getty apologize??   Maybe it will snow in Florida tonight too. I supplied the license for the image in my case and that wasn't good enough.

I do not believe that it is no longer present due to an "infringement" case. I do however question that perhaps Getty is no longer representing that particular artist or photographer.

I concur with Ms Peeved, tho we have seen in the past how some images all of a sudden jump in price after a demand letter has been sent..

Theres also this! I can see where Lucia is coming from with the emails, the main reason I would do it differently is for the nuisance factor, hell if they are going to waste my time and energy, I may as well make them do the same..especially if it get escalated to McCormack, at that point I would demand everything be sent certified mail, and any emails will be promptly rejected.. If it gets that far, it's clearly time to run up the billable hours for Getty..

I can only imagine this would upset Sam Brown, they don't like us airing their dirty laundry for all to see. My guess would be that any and all communications are priveledged and confidential, and perhaps even copyrighted! We've been down this road in the past. Naturally it's only confidential if BOTH parties agree to such in writing..
