Hawaiian Art Network began using PicScout ImageTracker in November 2009, at first tracking image use only in the U.S.  As of July 2010, the company expanded tracking to include usage in Germany, France and the United Kingdom.

The ImageTracker process for Hawaiian Art Network is simple and direct:
1.  PicScout identifies image usages by scanning websites across the globe.
2.  Every month, PicScout sends reports of these usages to Hawaiian Art Network via an easy-touse web interface.
3.  Hawaiian Art Network reviews the reports and determines if the use was legitimate or not. In most cases, Hawaiian sends the reports directly to a PicScout-identified legal partner for resolution as soon as an infringement has been confirmed.
4.  Infringing parties are contacted by the legal partner, advised of the infringement, and directed to pay an appropriate fee as compensation

I tend to believe that HAN gets a list of lawyers from picscout, as well as the generic FAQ that comes with the letters. Most of these lawyers are new and inexperienced, which boils down to be less expensive..It seems to be a recurring theme among the stock image companies..kinda like in the Movie the jerk, when the sniper picks Navin as his target..

Honestly? I'm usually annoyed by hand-written letters. There are two people I know who like to send them and I don't like receiving them. I prefer email or phone calls.

I don't know why, and frankly I'm not totally "with it" today from a mental standpoint, but this thread reminded me of the Getty v Avepoint case..so naturally I just went and hit up the pacer account again.. Apparently the case was settled, but not before avepoint fired back at Getty..

I found this interesting:

8. In response, AvePoint requested that Getty provide proof that these images are the subject of a valid copyright registration with the U.S. Copyright Office and that Getty has been assigned the exclusive right to enforce copyright infringement of these images.
9. To date, despite numerous requests from AvePoint, Getty has failed to provide this requested proof to AvePoint.
10. Despite its inability or unwillingness to provide this requested proof to AvePoint, Getty continues to wrongfully accuse AvePoint of copyright infringement, demand that AvePoint pay Getty for the use of these two images, and threaten litigation against AvePoint.

I would depend on the domain registration whois, if the whois lists the individual, then that is who legally owns the site and that's who gets the letter. In the grand scheme of things there aren't many suits filed.

I think you're over anal izing this.. is your case for 1 or 2 images?, if so offer them 50.00 per image, admit no guilt, and get on with life. You have a better chance of winning the lottery than them picking your name out of the 1000's of letters they send and  filing suit..they do not sue for 1 or 2 images it's that simple.

You won't outsmart them or out lawyer them on your own, if this is driving you that crazy I suggest hiring oscar for 195.00 and be done with it

Nope not at all, I'm suggesting that you replied the ball is now in their court, is all. Ultimately it's your decision on how you want to proceed.

If you sent a certified letter and it did not come back to you, then it got delivered...why do you insist on going back and forth with them?
