Just to show , just how in-experienced Mr. Aldrich is in copyright law, have a look at the FAQ from a Getty Images letter:

and compare it to Aldrich Law Firms FAQ..... they seem eerily identical, so my question is whom copied whom, is this not copyright infringement, changing company names and just a few words here and there would probably not fall under fair use..

This is actually the second time we have heard about Aldrich Law,please refer to this post, as I have already done some "homework" on this very young and in experienced attorney from Texas.

@FlameArtist it is good to see you are getting up to speed on this issue, this gives you much better leverage to fight this. Also please do consider sending your info to Matt as we don't yet have any actual documents, and it could be helpful to dissect the letter somewhat..

This is also a perfect example of why blog owners / publishers should spend a little extra money to become a registered agent, this would force these copyright trolls to issue a DMCA takedown notice, and that would be end of story. Providing the owner themselves did not post the offending content.

Hopefully they are both dead in the water, we shall find out next week, yesterday was a very big day, as 35 supporters flip-flopped and now oppose..although we all know money talks and you can bet that these huge movie / recording companies will be throwing more $$ in the pool to gain some back.

The defendant is out of the country until this Thursday, I already have a message into him..

Just a quick update to this:
I have spoken to Dr. Wetherman from the animal hospital, at this point as far as he knows the case has been dropped, however he was out of the country on the date the suit was filed. Perhaps he hasn't yet been served the papers.

He purchased a template thru Template Monster, and basically dropped it back in their lap. he did state that he had not heard from TM since. He is aware of the forum and that we have this thread going on, and he will be contacting TM's legal dept to get an update.

I know TM settled with Getty Images, but I can't say for sure if they had a suit with MF. I have also heard several times that TM will not step up to the plate, even tho they settled with Getty. I'm curious as if to whether TM just completely blew this off leaving the end user hanging, and also if this was indeed dropped. Hopefully the Dr. will visit us and bring us up to speed..as he was a little taken aback when I told him the date that the suit was filed..he was completely under the impression, that this was a done deal and no longer an issue.

I'm going to chime in here quickly on the removal of copyright information..

This can be done in 2 ways

1. if there is a water mark, clearly it is visable and also removable with some photoshop skills.

2. There is also a way to embed copyright information into the image file itself, so a watermark is not needed, but that doesn't mean it isn't there.

For example all of the images that appear here on one of my blog posts:

have watermarks, but they also have copyright info embedded in the file itself, most people would not know how to remove the embedded information, nor would they do it intentionally.. Once they have the image, if they open it in photoshop and do a simple "save for web" this action all by itself will remove the exif and any copyright information within the file itself. Most likely MF doesn't look at just the watermark or lackthereof, but the look at the exif of the file.
