The good news for Julie is that she will eventually force us to sanitize every reference and entry on her EXCEPT the ELI Home Bases:  The ELI Site & the ELI Forums.

She'll be hard pressed to sanitize every reference of her, I just stumbled upon this.

someone needs to refresh my memeory, wasn't there an issue with a compilation with MF in the past?

If the contract renews for 1 yr increments, unless a 90 day written is given, who's to say that this photographer didn't submit said written notice, and MF is simply leaving this out of the equation. If I were the defendant I would be getting the artist involved to testify whether or not this contract is still in effect..

I also can't help but wonder why they chose this recipient, among all of the others...was it the luck of the draw, or maybe he said /did something to really piss them off??

This may very well be a first for them, possibly sending a message to keep the fear factor in tact. I'd be willing to bet they have every single duck in a row, and are really counting on winning, to lose over 1 image would be hurtful..

Internet giant Google Inc. sided against copyright company Righthaven LLC on Friday in one of its appeals.

And in what turned out to be an unlucky Friday the 13th for Righthaven, judges rejected two more of its no-warning copyright infringement lawsuits over newspaper content.

you are correct, if YOU post something that infringes, you would not be covered, however if you had been a registered agent, and that poster came along and posted the cardinal picture, you would be covered, and you would have never gotten a letter as Getty would have had to issue a takedown notice. It would then be up to the poster to send a counter-notification, you would just be the "middle-woman". If you refused to takedown the image/content you could also be held liable..

It has been noted in the Righthaven fiasco that they intentionally steered clear of blogs with registered agents, because they just couldn't file suit, I'd be willing to bet that Getty does the same thing, as they have shoddy registrations and generally weak cases from the get go.
