You don't need to provide proof of , it's completely up to getty to prove their case, if it were me I would respond one final time and advise them, that from this point forward should they opt to pursue you further, you will be invoicing them for any time spent dealing with this...word it so that you are making them agree to those terms.

And this is the issue with "FREE image sites", there is no telling where those images came from, unless they are images in the "public domain"...If you have "proof" you obtained the image from a site purporting to offer "free", a judge may find you guilty of deminimus infringement...however they aren't going to sue over a single image, if they don't have the rights to do so, and if they believe your version of the story..it would be a losing proposition for them.

I would not fret, if it were i me, i would reply to them, that you purchased the images in good faith, and that you have proof. ( don't supply this to them) The onus is on them to prove their case..you purchased it in good faith , have the zip file, which you can present if they choose to file suit. I would also tell them that that you will be invoicing them for any further time you have to invest in this issue....

Congrats on reaching the SOL...now the trolls are SOL! If you're sure about the date, and they continue to harass you, you should respond alerting them to the SOL, and advising if they continue you will invoice them for your time, and if they do not pay, you will entertain filing a lawsuit against them for non-payment... ; )

"sent in error"...could mean anything the image in question is not registered properly, is for sale on multiple sites, is not even owned by minden..yada, yada, yada, douche bags like Koleta Vee at LCS are simply looking for a money grab..

Side-note" a quick search for Koleta Vee, showed the following as a result....another blogger who got a letter fro LCS, did some basic research and posted about it..problem here is this post contains in-accurate information regarding copyright, which makes me nuts...I would have gladly commented on his post pointing out his errors if I had the means to do so...maybe he'll see this post sometime in the future.. I think it's very important to have correct information, especially if you are trying to help other people.

always read and understand the terms of any images used..

I can vouch for Matthews research, I had previously gone through every single "office" and came to the same conclusion, they are all for the most part "virtual offices" Anyone considering a Bar complaint, should ALWAYS make sure you have a legit complaint, and this certainly appears to be one.

Matthew has a good idea, however, be sure to research what is required from both states, as it sometimes varies. some states have an online complaint form...such as Rhode Island..

And to the OP if you purchased it from IStock and have proof of purchase, I would not bother contacting them..don't waste your time,and let them waste theirs.. If they sue you file a counter suit, they will loose the initial suit and most likely the counter suit, and you just might come out on top.

ughh, time to run up the PACER account... already looked at one and his scumbag son is also a co-plaintiff....rotten apples never fall far from the tree.

As usual he's bitching about the "infringer" posting his images on FB and Pinterest, thereby allowing the images to be shared/spread all over the internet,....um little late for that I wish someone would point that out to the judge.

Yeah the general consensus, is this guy is a douche-bag of massive proportions. I have been directly contacted by about a dozen people ( who all wish to stay anonymous, except for one ), via email, text and telephone. Every single one of them reiterate how nasty, ruthless, and evil he is and can be. I'm not reporting or blogging about any of the gossipy stuff, as I can't really back any of that up with documentation, but the picture is certainly clear in my eyes.

well yes, technically you can, and it would likely be considered a derivative, but nowhere in the actual statute does it state any certain percentage...that's folklore that has been around for years and years...

This just proves how many people are non educated on basic copyright, lawyer or not, people just don't know...One of the funniest things I always here is: "If I change an image 30% it's not infringing", heard it just yesterday..That's like saying I can use an image of Mickey Mouse, put some different clothes on him, and Disney wouldn't mind or try to protect their IP....
