we could probably use the OP's letter to his/her congress person, as he did give MCFilms to use bits, at least for a starting point. I agree it's a good idea, but my writing skills pretty much suck, as evidenced by my posts, and as mentioned there is the time factor.. Maybe another idea if someone is willing is to draft a letter that can be sent to different media outlets, from small home town papers to larger publications, and maybe even TV shows or news related youtube channels not that it would get us anywhere, but it couldn't hurt to send it out there.. I keep thinking of Shawshank, and Andy writing the state everyday for a number of years, but he finally got the library..

perhaps something with "Champions" not as in that we're the champs, but more like we are championing the cause, I also like the idea of a Mascot named Eli. I know a couple of graphics artist that I'll be speaking with, to see if they will be willing to donate a couple of hours to mock something up

Before you use my text, let me first go register my letter with the copyright agency (after the fact). That way I have better standing when I send you the ELI Extortion Letter.

The ELI Extortion Letter is the one where we suck in people to read the multiple letters I have written to various lawyers, agencies, etc. and "seeded" into Scribd.  Then, when you incorporate the text I originally wrote into your own letters, you will then receive a screenshot of the Scribd document, the "after-the-fact" copyright registration, and then the Shakedown Letter asking for $1,200 which I will kindly accept $500 because I am in a charitable mood.  Of course, I have to include the customary FAQ in case you have any issues with what we sent.

How does that sound to you?  :-)

Matthew - Thanks for the pep talk and for everything you do here.  I am going to at least give it one more try on my own using all that I am learning here.  So, if I use some text from one of your letters you won't site me for copyright infringement?   ;D

At best, it appears to be Righthaven Lite. It doesn't sound like they'll totally pull a Righthaven, where their first move is to sue, but rather (from the various vague descriptions) it sounds like NewsRight will be going around simply trying to get blogs and aggregators to buy a license. But here's the thing: on what legal basis? That's the part that's not clear.

It could be the judge could see it that Tylor knew his images were going on the wallpaper site ( however they got there) but if he did nothing, nor could he show that he at least tried to take action..in other words he just wrote it off as shit happens...then a judge could certainly rule that there was an implied license..either way it can't hurt to have this as part of your defense.

The judge has set a new hearing date for Monday, January 9th at 9am. I can't imagine that the Gibsons and Mangano could possibly think they can get away with missing that one, too -- but if you had asked, I never would have believed most of the things that Righthaven has done so far would ever happen in real life.

I think thats what he is trying to say, yes it would / could lower any award amount, but copyright infringement could still have happened. I tend to think or hope anyway that most judges are reasonable and would use common sense in their final decisions.. Showing a judge one of these wallpaper sites that have a creative commons license attached ( and there is at least one that I've seen ) would likely deter a judge from finding that infringement did occur..at least thats how I see it, but I could be being overly optimistic..

Furthermore if HAN and Tylor do know about these free sites, why are going after the small fish for having downloaded 1 or 2 images, when they could sets their sites on the wall paper sites, some of which have many of his images posted, wouldn't that be a better revenue stream for them? I would think so..but then again by targeting small mom + pop outfits with the fear factor, they probably get better results with people just flopping over and writing checks..

and I still question why none of the other photographers associated with HAN seem to have this "problem", maybe they are not seeding or uploading to webshots....

SG has some very good points, show me where it is documented that you are doing everything in your power to have the "free" images removed, cause if they aren't then they are just part of the problem and guilty by association...just my 2 cents worth...

I think they left out the fact that there are probably financial records on those drives as well...wouldn't want to tell anyone where all the money went, now would we??

My thoughts exactly! In coding there is such a thing as a "code sprint" where programmers get together for a concentrated effort. It can be a few hour over over a few days. But imagine if all the ELI members got together, hunted down the most prevalent purveyors of "Free" wallpapers that use HAN images. From there we could "notify" (because I'm sure they are unaware) HAN that these sites were indeed giving away there images. This would effectively shut down this process.

This is too late to help anyone going through this right now. But it might serve to prevent future victims. I can give a few hours to this some evening.

I could throw some time into it as well, let's co-ordinate it. Tineye should give us more than enough to get going, I think we might need 1 or 2 more willing souls..
