Great find Lucia, wouldn't it be something if they offered this up and it was not for the image in question!! It's one thing to use scare tactics, but this would be really low, unethical, and truly disgusting!

I also see the domain auction has stalled at 1950.00, I say clear out their office of everything, then go after his house, car and anything else available!

This won't come as much of a surprise to anyone following the ongoing battle between Righthaven and Marc Randazza, representing Wayne Hoehn (Randazza is also representing other clients fighting Righthaven, but much of the "action" is in the Hoehn case). The latest is a filing (embedded below) for the court to declare Righthaven in contempt of the court for completely ignoring a court order from December 12th to produce certain documents to Randazza as part of the effort to collect the attorneys' fees that the court has already ordered:

Great conversation going in this thread. Something else to consider in the advernet case, is the fact that Getty couldn't even show a contract signed by both parties, this just tells me they are somewhat sloppy in general, so I would also believe they would be sloppy in registrations as well as other areas. the letter senders are all college aged interns with no law background and they are "trained" to follow the script. I'm sure Gi is aware that x nuumber of recipients will just roll over and pay the demand with out asking any questions.

As 2011 concluded, problems with unpaid bills continued to pile up for copyright lawsuit filer Righthaven LLC of Las Vegas.

Records Saturday showed Righthaven has been sued by its own process server and also faces a request by defense attorneys that it be found in contempt of court.

Seems like Alaska Stock has lost a suit, not once but 3 times..

Alaska Stock – no relation to Sarah Palin – is a stock photography agency. Houghton Mifflin, a publishing company, licensed a number of photographs from Alaska Stock for use in certain textbooks. Subsequently, Alaska Stock asserted that the licenses included quantitative limits, which were exceeded by Houghton Mifflin. Alaska Stock filed suit, claiming copyright infringement.

I'm sure there are plenty of people paying these demands, lest they would not be continuing to send out letters, it makes up a very large part of their revenue.

As far as we know, no one has been brought to court over 1 or 2 images at this time. naturally this can change at any time, but I find it unlikely as far as Getty is concerned.

Almost missed this one, but Eric Goldman alerts us to the dozen comments filed with the US Copyright Office concerning its plan to force everyone to keep re-registering their official DMCA agent in order to keep retaining the DMCA's safe harbors. As we've discussed in the past, in order to make use of the DMCA's safe harbors, you have to register an official DMCA agent with the Copyright Office. In fact, we've suggested that anyone running a blog or forum site do exactly that. Many of the companies that were successfully sued by Righthaven (before it was discovered Righthaven didn't really have the copyrights it needed) were caught because they failed to register a DMCA agent. While I think that such sites could make a reasonable argument in court that they still were not liable, it's a lot more difficult (and costly) to do so.
