Righthaven LLC, the Las Vegas newspaper copyright lawsuit company, filed an emergency appeal Tuesday to block an auction of its copyrights — an auction Righthaven says is aimed at dismantling the company, even though the copyrights are “allegedly suspect.”

So late Monday afternoon Randazza filed a motion asking the court to order US Marshals to take the Gibsons into custody so they can be compelled to transfer Righthaven's copyrights.

Pretty amusing, I've seen them on several sites, I suppose one could argue that if you have this on your site and get a letter from getty, you might have a case against them..whether it would stand a chance is beyond me.. I real curious as to what their reaction would be if someone were to throw this back at them, my guess it's not written in the "script" anywhere.

the main issue would be the fact that they are not in the US, I'm fairly certain if they were here, they would be in a heap of trouble.

Good find!, Great Links!! There has been some suspicion that a certain stock image company / photographer is doing just this, just a matter of proving it. While i agree that getty can be sloppy as you noted, I don't think they would stoop to this level, nor would they need to... Over these last few weeks i have actually gained a bit of respect for Getty....wait let me rephrase...I still strongly believe that the way they go about enforcement and their tactics are wrong, but they are much more professional and shall we say "human" than some other new players on the block..

Copyright lawsuit filer Righthaven LLC of Las Vegas is refusing to turn its copyrights over to a court-appointed receiver so they can be auctioned — causing attorneys Monday to seek an order enforcing the auction plan.

Righthaven last week was ordered to surrender its intellectual property by Monday so it could be auctioned for the benefit of creditor Wayne Hoehn, who defeated Righthaven in one of its copyright infringement lawsuits.

Being that Google adheres to robots.txt, the following can simply be added to your meta-tags in the head section of your pages

<META NAME="ROBOTS" CONTENT="NOARCHIVE">

you can also have any cached pages on google removed by following these directions

http://support.google.com/webmasters/bin/answer.py?hl=en&answer=1663660

Be sure to select "Remove cached version of this page" or you might inadvertently removed your pages and not the cached version

I see he completely did not respond to the fact the image came from a free site along with a Creative Commons license!...Typical bullying tactics at work once again. I'll end you a PM in regards to sharing your documents / emails with the community..

::EDIT:: I hardly think one can compare a teenage girl downloading music to a stock image that was available for download with a CC License...as an attorney you would Mr. Aldrich would realize this..

Chances are you'll never get a manager on the phone, if you have the invoice from 05 with the template in question, this should be sufficient, as the suit they settled was after that.

Purchasing another of the same template will not help you, as they will be looking at the date of purchase. GI won't care if someone else bought the template, they only go after the end user. As stated previously they most likely will not file suit over 1 image, and anybody you contact at Getty will only read the corporate line, they are a bunch of college kids and have a premade script to read from  / memorize.. You could try to contact TM, but since you did not purchase it, they won't be of much help either...sorry to say

well hell if you're closing up shop, just dissolve the corp.. If it's an "s" corp, they can't go after anything personal ( I think) if the corp doesn't exist, there is nothing for them to pursue..

Agreed on the numbers MF should supply them, I believe most if not all of their images are registered. They are also known to be aggressive and if memory serves me correctly they have and will file suits over a couple of images. Personally I would see to it that the developer take care of this, whether she has invoices or not. If she is unwilling to step up to the plate, you may have to pay MF then chase down the developer to recoup any expenses.

This has been going on long enough that all developers and designers should be aware of this and thus should be able to avoid it in the first place. I couldn't imagine leaving one or any of my clients on the hook for something like this, maybe i'm just old school..

I read it as that only part of the image was included in the template, and thats the part picscout picked-up on, and Getty along with the screenshot sent a reference to the entire image.. I agree it's probably a royalty free image and not registered, they will likely not follow suit over 1 image, whoever if it template monster, they they are the responsible party and although it may not be worth it to send it to them, it might be a way to make it go away..as we all know GI will continue to pester the end user..
