Righthaven LLC, which still bills itself on its website as "the nation's preeminent copyright enforcer" is now on its way to a new title. It may soon become the nation's first copyright enforcer to be forced into bankruptcy by sanctions awarded to the targets of its copyright infringement lawsuits.

The copyright protects the artwork from the time of its inception until 70 years after the death of the artist. Upon the artist's death, her legal heirs and relatives own the copyright to the piece of art. In the case of a joint work, they copyright lasts 70 years after the last artist dies, according to the United States Copyright Office website

If they respond to you I would quickly tell them to suck ass, they have nothing, I would also re-quote the following:

This is interesting...was the "comment" with the image on your blog which you own ( and own the domain) or was the comment posted on a forum of some sort?? I'm curious as to whether they have resorted to finding images on forums, then tracking down the poster..seems to me like it would be way to much work for them, considering they would have no standing whatsoever if the image in question was actually hosted someplace else. The whole with these companies is to use the scare tactic...send a nsaty threatening letter and x amount of people will freak and pay up... Feel free to link back to us here in your blog posts, maybe some of your commenters will come visit and help spread the word.

It's no harm in responding to them, as it could help down the road, if the image never resided on your servers and was being pulled from somewhere else, they have no case, it was good of you to point out the perfect 10 case, you could have gone a bit further and quoted from that decision..worst thing you are guilty of is using someones bandwidth. In the letter they sent did they provide you with a screen capture and a path to the image in question? The path is the key, if that indicates it is coming from a different doamin, they need to go pound salt...

THEN Marsinko sued a photography studio, stock-image providers and greeting card companies in September, saying he never authorized the photo to be used for commercial purposes, and that the card resulted in insults and ridicule.

NOW The suit remains active in Roanoke County. All the defendants have filed responses denying liability in the case. One defendant included a copy of the permission form Marsinko signed.

The form grants permission for Marsinko's photo to be used for "promotional, illustrative and editorial purposes," and also states the photo will be used specifically to promote the fair and for the photographers' "personal project," a portfolio of people and their livestock. The issue of whether Marsinko's image was exploited when it was sold to a stock-image company will be central to the case as it goes forward.

Farmer Andrew Marsinko and his goose posed for a photograph to promote the State Fair of Virginia back in 1996. The photographer subsequently licensed the image to Jupitermedia, which licensed it to Getty Images, and in 2006 it wound up on a gag greeting card that Marsinko found offensive.

Righthaven has finally gotten around to filing its official appeal in the case against the non-profit Center for Intercultural Organizing (CIO). If you don't recall, this was the case in which the judge ruled at the summary judgment stage in in favor of fair use, even though an entire article was used (the issue of Righthaven's standing concerning whether or not it actually held the copyrights in question was not raised in this case, since it was before the agreement between Stephens Media and Righthaven became public). The argument is embedded below, but Righthaven basically hits on two points:

1. The judge erred in ruling on fair use at this point in the process.
2. The judge's fair use analysis itself was wrong

Good find SG! sign me up too, I love working for free....a quick tineye search for one image from magnum only returned 848 results....and surprisingly enough a quick search of a certain photographers name brought the "National Geographic" site and the option to download the high res version for your wallpaper...Shame on National Geographic for being a part of this...yes it's in the terms to not use the images for any purpose, but they should realize most folks aren't going to read the legal side of things..
