Obviously his blog is completely self serving, his goal is not to assist his fellow Canadians, but rather to just let people post away, all the while knowing the search engines will eventually pick it up and give him and his law firm exposure...This is just my opinion..hopefully readers of his blog will continue to search and research, if so they will most certainly land here after all EXTORTIONLETTERINFO.COM is the go to source for settlement demand letters regarding stock images for many people around the wordl!

I tend to agree, however the more we collectively share to outside sources, not only do we ghet more exposure, we also enhance the chances of our plight being picked up by more streamlined and reputable news outlets..that will give us more leverage as a whole.

yes, well they wouldn't want to be on the receiving end of a demand letter! To bad they didn't do this before the scented tree lawsuit came along...I feel for them..NOT

It would be nice if it would "go away pretty quick" should people stop paying however, I do not think it will happen any time soon!

Just fyi, it's not just "stock" photos. I also ran across a graphic website owned by Jupiterimages a division of Getty Images.

Similar situations have happened before, they are well covered in the forums, keep reading and get educated.One item worth noting is that your client would need to retain Oscar if that is the end decision, naturally you could foot the bill for this, but Getty will not want  to deal with you as the developer, bottom line is the domain owner is responsible.. Might I suggest password protecting projects that are in the develop stage from here on out.

Below is a link to the 2011 “GETTY IMAGES CONTRIBUTOR AGREEMENT”

Clause 1.11 states

“You authorize Getty Images and Distributors at their expense the exclusive right to make, control, settle and defend any claims related to infringement of copyright in the Accepted Content and any associated intellectual property rights (“Claims”).”

I am not a lawyer, but this seems like both Getty and its “distributors” would receive the photographer’s legal permission to file lawsuits in cases of copyright infringement.

In other words, if my understanding is correct, a “distributor”, whilst not the owner of the exclusive license (that would remain Getty Images) would still be allowed to pursue legal action.

Would this not be in contradiction to the recent Righthaven decisions that only allows copyright owners or owners of an exclusive license to take legal action in cases of copyright infringement?

I have not had a chance to read thru the entire file, so I may have more questions as I make my way thru it..

Elisa Pauline Stewart: i have been reading your response style and find that while you swing your clout with heavy accent, you balance with ridicule, debasing remarks and very chauvinistic backlash, kinda like rednecks and pitbulls.
