We had our link added to http://fightcopyrighttrolls.com/,although the trolls they fight are of a different "species", the methods and business models are closely related.

"Thank you for visiting and bringing my attention to extortionletterinfo.com. I heard about Getty Images cases, but did not have a chance to look at the details yet. Although we fight with different troll species, they all have many common features and use similar methods: the core of their “business” is based on the abuse of the law and tactics borrowed from the mafia.

I’ll definitely stop by to say hello and read the discussions.

Unethical greedy lawyers and companies are better equipped, but we have a powerful weapon in our disposal: publicity. I believe that victories on out frontiers benefit everyone, thus spreading the word is essential. Keep up the good fight,

SJD

I linked your forums from my Resources page."

« on: November 17, 2011, 05:36:43 PM »
I just dangled a rather large juicy carrot in front of Steve Green's nose, Steve writes for the Las Vegas Sun, and has done some stories related to Righthaven, I figured why not, Righthaven is quickly coming to a close, so maybe he needs a new project as it were... Hopefully I will hear back from him, or he will appear here for a look see..will keep you all posted.

probably not, but they can see it thru archive.org, and perhaps googles archive..there are some posts here regarding getting removed, kindly use the search feature, as I'm too tired and worn out to type it all right now..

Getty Images Letter Forum / an interesting article on entrapment..
« on: November 17, 2011, 05:22:17 PM »
Ok I know and realize this has direct ties to Righthaven, but I think it could apply here as well. IMHO I think it's pretty safe to say that some companies /artists / photographers are seeding wallpaper sites in the hopes of following up on folks who see the "FREE Download"" button, and don't know any better and use the images on their sites.. Interestingly enough I even see the word "extortion" used several times, as well as "shakedown"

Here are a couple key points:

"In addition, the LVRJ.com website encourages and invites its users to 'Email This,' 'Save This,' 'Print This' and subscribe to its 'RSS Feeds.' This not only puts the users of LVRJ.com in a quagmire, but it is the opinion of the defendant that LVRJ.com is guilty of entrapment, or at least setting up the users of LVRJ.com for a potential lawsuit. " .............remember that "FREE Download"" button I mentioned???

"This lawsuit is entirely predatory, frivolous and an abuse of the United States justice system. While the defendant acknowledges that the plaintiff is not bound by law to issue a cease and desist letter when an alleged infringement is found, it is the common legal etiquette and process to begin with a cease and desist letter. Had such a cease and desist order been offered, the defendant would have cooperated and obliged accordingly. The opinion of the defendant is that in not issuing a cease and desist order prior to filing this lawsuit, the plaintiff's sudden filing of a lawsuit alleging copyright infringement is unethical, immoral, improper and indicates a suspicious motivation to do so.

"Plaintiff is engaged in a shakedown or extortion operation, with the express purpose of abusing the legal system to extort or shake down webmasters and bloggers who republish content from the Las Vegas Review-Journal in accordance with 'fair use' and the Digital Millennium Copyright Act. In the majority of cases, including that of the defendant, victims of the plaintiff's witch hunt are bloggers and webmasters who generate very little revenue, if any, from their sites. ... The plaintiff is operating with expectation that the victims of his `copyright trolling' operation will settle out of court rather than absorb the costs of fighting this matter. "

I'm going to dig a little deeper and see if  judge ruled on this aspect, as it could mean something big coming down the pike to those that like to sow their seeds of wickedness!

Law Society’s Professional Conduct Department

The Law Society is the organization that licenses all BC lawyers. It protects the public by setting professional standards of conduct and competence for lawyers; it monitors, evaluates, and disciplines them.

The Professional Conduct Department has commercial crime investigators, forensic auditors, and lawyers. The Department reviews all complaints against lawyers, as follows:

First, the Department decides if they have the authority to investigate your complaint. If not, they close the file. If they have the authority to investigate, they look into your complaint in detail and contact the lawyer for a response – so the lawyer will learn of your complaint. Then, they do one of the following things:

Take no further action if the complaint cannot be proved or does not show conduct serious enough to justify further action.

Send the complaint to the Practice Standards Committee if competency is the issue. That committee decides if the lawyer needs to upgrade skills, change their practice, or obtain other guidance.

Send the complaint to the Discipline Committee if there are ethical concerns or breaches of Law Society rules. That committee decides if there should be a review of, or a formal disciplinary hearing into, the lawyer's conduct.
Law Society discipline hearings are like court hearings – Law Society staff present the case against the lawyer and the lawyer gives his or her side of the case. A hearing can lead to:

A reprimand (a warning) of the lawyer.
A fine up to $20,000.
Conditions controlling how the lawyer works.
Suspension of the lawyer from working as a lawyer or from working in one or more areas of law (with or without conditions) for a certain time.
Disbarment of the lawyer (meaning the lawyer cannot work as a lawyer).
For more information on the complaint process, phone the Law Society at 604.66

I will be embarking on a journey on chillingeffects.org as well as eff.org, I think they may be interested to see whats been going on as of late.. as has been stated many times before, those who make the choice of entering this arena need to be prepared for whatever comes their way. I encourage all community members to help spread the word via various channels as I strongly feel that the events of the past few days can work to our advantage going forward.

Thanx for chiming in MC, very well put, and I could agree more that we need to band together and get more exposure. Matt has spent a great amount of time with this week alone, just dealing with the latest barrage, so yes the donate button is helpful, as is , doing a small part by researching and getting word out.
