2- how likely is it for them to file suit in another state?

They would HAVE to file suit in your state, and as mentioned in Federal Court..

MF does file suit, and they generally have their ducks in a row...that being said, they also know you got the letter if it was registered. Claiming you did not know it was copyrighted won't work with them, and claiming the site had only 60 views with no ads, won't much matter either... My guess is they will hound you..only you can decide to engage them, and maybe get them to lower the price, or totally ignore it and roll the dice as it were.

I too, am curious if the demand letter came from LCS?? I see that Adlife has some recent entries in PACER in regards to lawsuits filed, but I haven't looked into them further as of yet. As already stated, do a revrse image search and determine if this image is availalbe t license elsewhere, if it is the onus is on AdLife to prove their case....whos's to say you did not purchase it elsewhere??

It's been stated before, here it is again...

you have Getty Images....who also owns a bunch of smaller stock agencies...

Getty purchased Picscout, the scanning software company that finds supposed infringements.

Getty than came up with and owns LCS who works with Picscout to send out letters..

at the end of the day, the are one and the same.

no it's not legal per se... I can use a public domain image, say on a t-shirt and charge you to buy that shirt, this would be legal and happens frequently, but I can't download that public domain image and sell you a license to use the image....2 totally different scenarios

If you decide to reply to them, and if it were me, I would tell them to shag off...if the image is availalbleto license/purchase elsewhere, then it's up to them to prove their case...who's to say you didn't obtain it elsewhere?...Just be careful in your wording, don't admit to anything and don't prove their case for them..

Congrats to my friend Steven Drizin and the rest of the folks at Northwestern University for the overturning of Brendan Dassey's conviction!!

I'm not so sure the word "growing" is the right one, they might be sending out more letters, but some early research reveals that Higbee & Associates is no "National" Law firm, while they boast locations through-out the US, the vast majority of those locations are all "virtual offices", in other words an address they can  use, and have accss to a meeting room in an office building. I will be making a separate post showing all of this and unfortunately there will be other businesses and attorneys now associated with asshat Mathew Higbee... I willalso be revealing that Higbee does not seciliz in IP law, but rather it seems their niche market is immigrtion law and "record expungement" services..more to come soon!

I'm calling this asshole Mathew Higbee out, right now, right here!..a simple search of one of those google map markers, does indeed have results....for another attorney...nope, not Mathew Higbee at all...

address: 1001 Texas Ave. Suite 500 Houston TX 77002

This firm doesn't even do copyright, but rather they offer an array of law areas, ambulance chasers in my opinion. I might have to research all of those markers, just to make "Attorney" Mathew Higbee really look like a douchbag.

I knew I knew that name, one of our regular users has been targeted by them...not sure of the status of his "case" though

Nancy Wolff doesn't really have a good reputation around here, she' been tossed under the bus before, and once again it appears Nancy Wolff from DMLA ( PACA) is once again making an ass of herself.....the below snippets are from an old thread found here:

 http://www.extortionletterinfo.com/forum/profile/?u=1;area=showposts;start=780

"The advice disseminated by Nancy Wolff to PACA members has effectively been neutralized as insufficient and blatantly ignores what has been stated in the Copyright Act as a proper copyright registration."

"If Masterfile hadn't stupidly tried to claim $6 million, maybe Chaga and Oscar wouldn't have had to embarrass the entire stock photo industry most notably PACA, Nancy Wolff, Steve Weinberg, and Masterfile."

"These documents are very good reading and quite a brutal and explicit setback to those who followed Attorney Nancy Wolff's and PACA's "shortcut" and circumvention copyright registration advice.  Every member of PACA who followed Nancy's advice has found out the hard way her advice did not hold up."

While we're on the subject of being "out", I suspect that pot isn't the only thing Timothy B. McCormack is smoking...

nice observations, boy I hope these 2 suits get to discovery...will be fun watching Getty squirm!

.. I'm betting that, those fucktards Jonathn Klien and pot growing Timothy McCormack are glad they got out of this..

I've been out of the loop for some time but
I did not know that Timothy B. McCormack actually "got out"?
Interesting...I was under the impression that he was still sending
letters on the side so...good to know.

May the entrepreneurial Timmy continue to "grow" in his new endeavor.
Movin' on up...I'm tearing up now.

It has not been confirmed that he is "out", but he's been very quiet as of late, so that's an assumption on my part..
