Two very good points SG & MC. I could see maybe Getty's interns not realizing this, but I find it hard to believe that McCormack would take part, unless of coarse they are just taking the corporate BS at face value. I personally would draft something up referencing what SG quoted, and stating that you want something in writing from McCormack, that this matter is dropped or you will consider any and all legal options before you. i.e. fraud, harassment, etc..

On another note I think this is how alot of folks get caught up in this mess. They get permission from another site owner to use content / images, when in fact said site owner may not own the images, so they really have no right to grant this permission. However linking to is a different story..which naturally has me thinking again for way to better protect my clients..more on that after I digest some much needed caffiene!

I could be wrong in my thinking here and i'm sure Oscar will correct me if so..

The infringement occurred in 2007 according to the OP, GI knows this, I'm sure they have screen captures.. based on the maximum amount of 200.00 per unregistered image ( assuming they they are not registered, it would be the same as offering 150.00 per image / per year since the infringement took place.., hence 600.00 per image x2 = 1200.00..

Seems they have the money to pay the CEO, and Lawyers, but no money to post the bond..

I wonder if GI has removed all of these images? I was thinking maybe I should run over and purchase them, then raise a fuss with GI when they loose this case, I could send them a letter demanding a full refund and a little extra for the aggravation of them selling me images they had no right to sell.. I could even "claim" I was contacted by the freshener company, and demand more and not show proof, tell them I can only show that when I sue them..

Just kidding of course I'm not one to stir the pot

haha, probably the same way I really can't afford to buy lotto tickets, but I somehow manage, hoping against hope that the numbers come in! I think right now they are not pursuing anything expect to weasel out of the demands being put on them, and trying to get a different judge to rule differently.. I do believe this ship is now listing approximately 40 or so degrees, and the end is near..

If site-studio is supplying images, via their templates they should step up to the plate and address the issue, have you opened a line of communication with Getty? It would be worthwhile to do so and explain that the template was part of your hosting package, but was supplied by a third party (sitepoint) Getty may be willing to pursue this directly with them if you can somehow show them this is what happened. Shame on your hosting company for not standing up to this, if it were me I would be pulling my business and going elsewhere..

Have you researched the image in question, how did it get on your site, did you purchase a license to use the image? is it your own photograph taken by yourself? Did you web person obtain the image?? if so how and where? Time to do some homework! Read the forums, get educated, track down the origin of the image, see if it is available thru multiple sites, ect...

Perhaps a quick email to the legal depts. of other well known companies, bringing this to their attention is in order... Getty's library has plenty of images showing other trademarks, logo, etc... I wonder how Happy Coca Cola would be to know that Getty accepts images containing their logo, then sells the images??

If you were willing to split it with the client in the first place, why not just explain to the client the options and offer to foot the bill to hire Oscar on the clients behalf, this way the client pays nothing, and you still pay less than splitting it, it's wa win win for both party's, the client is covered, and you keep the relationship in good standing..
