I think that this letter is just another approach. Some people get suspicious and think that you are in a weak position if you threaten too much. Like a dog how is frighten he will bark even louder. If you say : “Pay the money because you owe it to us” this implies : I do not have to threaten you because I will get it from you anyway. If the Hells Angels come to your house and ask politely for money it is still threating

Hello Matt
If the photo is on the website of the photographer see if you can buy it from the photographer that would prove that GI has no exclusive rights. Make a picture search (Is threre another place where you can buy the picture) I am not an expert but the copyright in Switzerland regarding photos is a little bit complicated and not so easy ( see Court Case Meili and Bob Marley). I am not sure but as far as I know they have to get a court decision that there has been an infringement. After this they have to ask for compensation and then the Art 62 comes along. I would go and ask all the questions which you find in the forum.  Keep in mind they did not prove anything to you. They just try that you admit how long you have used the photo.

Do not assume anything with GI. They are not well organised. They mix up photographers and will give this to you in writing. I have got a letter where one of their Directors  testify that they have checked everything and everything is in order. The problem is that they mixed up the photographer. 

Just read everything carefully and do your research.

I thing they have got a modified letter (download) which you could send to the lawyer. I think according German law they have only three years time to bring you to court (statute of limitation = in German : Verjährung). So start buying time.

Usually big banks have big law department and high paid lawyers and they lost in foreclosure cases just because they did not have done their homework properly. They wanted to make fast bucks and neglected the paper work. I think GI is on the same path.

We had a contract which said that I got the copyright oft the pictures. 

With regards to the photo industries:
I think that there is nothing stable outside there; everything is changing fast. Look at the travel agents 15 years ago and today. Or look at the company which produce the blackberry phone (RIM). They had really good times and now they are almost broke. And I am convinced that GI needs the extortion letters to survive.

I got the copyright. He took photos of my products. But it may be different with product photos I did not try other photos yet.

For 900,-- $ you will get a decent photographer for a day and afterwards you will have more then one photo and you will get the copyright too.

I used the Stone Collection just as an example since I come across a thread http://www.extortionletterinfo.com/forum/getty-images-letter-forum/getty-and-the-stone-collection/   and I tried to use this info to draw a conclusion out of the facts we got from the court papers 
