So if you're broke, and they sue and win, what do they collect??? zero I would assume... you need to keep reading ,getting educated, then decide what is best for you. That decision is completely up to you.

FDCPA only applies to debt collection issues not copyright claims which is what they are attempting to do.

Historically, NCS IP Solutions don't really do anything except send letters. At some point, they will punt it back to Getty.

You will not stun them into silence. It is simply a matter of disregarding the letters if you don't feel you should pay.

I'm not sure I agree with this assessment. NCS is certainly trying to collect on something they see as debt,even though it is clearly a "claim".. By stating as much I think they are legally required to punt it back, and cease any further communication. IMHO a second letter would make them think twice, however,Getty will simply "escalate" the case to one of their "Lawyers" ( term used loosely) like Seattle Attorney and drug dealer Tim McCormack.

My thought is you should contact the photographer ( since you didn't name her for some reason) and urge her to file a lawsuit against LCS, since they appear to be illegally profiting from her works, which reside in the public domain...

I would respond to LCS informing them you will be invoicing them every time they try to harass you going forward.

You are most likely thinking of Masterfile, they are a bit more aggressive, but they do not use LCS as their "collection agents", for lack of a better term.

Great news Greg, just goes to show if one is willing to fight back for what is right, these assholes can be taken out! We see so many people simply cave, because they are either to afraid, ignorant or just plain lazy, which in turn just keeps the trolls in business.

I guess what i'm trying to say here, is that neither wordpress.org or .com is going to check to make sure everything is licensed properly, nor should they. They are leaving it up to the theme developers to be diligent and honest, which many are not, and many just don't care, especially those from foreign countries. They don't care about US copyright law. So WP having that in their "terms" most likely releases WP from any liability.. at the end of the day it's the end users who needs to be diligent. Also keep in mind these trolls target low hanging fruit that have no legal background and are not willing to fight back, it's a total money grab.

Getty did not care that the image I used was purchased in good faith, with a supplied license agreement, from someone who apparently swiped the image, then sold it.. I was still on the hook, but I fought back and flat out refused their demands.

I'm fairly certain that theme developers do indeed offer their "code" under GPL, but this would not include "images".If it's a self hosted site, the site owner is responsible for content.. It's all very simple, if you used an image that you did not create, did not purchase a license for and it is not"public domain",chances are good you infringed...NEVER trust sites that offer "free" templates" "free themes" or "free images", as there isnot telling where they come from....IMHO 10% 50% or 100% doesn't really matter, nor does it really matter if you infrnged, it'snotthe end of the world by any means, the big question is how to proceed and just what exactly is LCS going to do...chances are they will just hound you and chances are less than 1% that the artist will file a lawsuit.

Your "programmer" needs to step up to the plate here, he/she should know better than to "source" images from a google search... Time to get educated, you need to read the forums and decide how to proceed..All the info you need is here, but you'll need to do the foot work.

I've also seen a case where Getty tried to enforce copyright, and the artist had previously pulled his artwork from them, and did not renew the contract....these douche bags can be slippery as eels.

it's possible. anything is possible...it's also possible that the photog never signed a contract with Trunk, don't take them at their word..we've seen Getty state that exact thing in acourt room, but had no signature from the photog...end of case right there... remember with many of these firms, it's about money andnot about protecting copyright or the artist. If you know the artist name, search their works n the copyright database, if it's not registered better for you.
