That is sooo sad.  Makes one think it is time for someone in power in our legal system to make an example of these trolling scheisters.  Disbarment and retribution might be a good start.

By law, the statute of limitations definitely begins when they discover the "infringement".  Everyone on this board recommends your first letter date because, as Robert says, that is proven by the letter.

If you have another way to prove when they discovered the infringement, that will work.  But the keyword is PROVE.  As Robert says, they can dispute the computer date.

It's amazing that someone with common sense would not automatically overturn this.  I guess justice isn't always what it is cracked up to be.

You should definitely get educated on this forum though. 

There is no way that this incident should hit your client's business ratings, because at the moment, Getty is just making a claim.  They make it sound like they have proved copyright infringement, but they haven't proved that the copyright is theirs to enforce.

Spend some time on this forum.  The more you read, the more you will understand that this is a business plan to separate you or your client from your money.  There are a number of ways to proceed, but for $200, Oscar's letter program should get you and your client off the hook and out of the communication loop.

Only you can decide what route is best for you.

I don't know a lot about facebook, so this is just conjecture, but perhaps, picscout doesn't know how to do it.  I believe there is some security built into facebook.

My understanding is that if Person A posts something, they may be liable for posting an image to which someone else holds the copyright. 

However, if I see my friend Person A's posting, and I share it, I am not liable.  That's because the act of sharing is providing a link to the original post.

I am not sure if/how picscout can trace something I may have shared back to Person A who would be the only person liable.  If Person A is not in their friend network, it might be more work than those trolls want to do.

Chances are that the company you hired to build the web site didn't do anything wrong - and, even more likely, didn't intend to do anything wrong. 

Like most who have found this forum, they could have gotten caught by many of the "traps" Getty appears to set to snare small companies into their extortion letter program.

Greg gives you good advice.  Get educated, stay strong, and figure out the best way for you to fight their program. 

I have been in this fight for 1.5 years and I do not see Getty going after large companies.  Instead, they appear to use their size, to intimidate and harass small companies and individuals.  Many people will eventually give in to bullies.  But every now and then, a bully tends to pick on the wrong guy, and they get what is coming to them.  I, for one, cannot wait to see the day that they get theirs.

I know Matt has had some issues that will take some time to sort out thru the court system, but I just wanted to say that I, for one, seriously miss his posts on this forum.

Matt is such an outside the box thinker, that even if he didn't come up with the best solution to an extortion letter issue, he spurred others to think outside of their normal scope.  Often, that was enough to help delineate better alternatives.

Matt, I for one hope that when the time is right for you, you will be back with a vengeance.

Interesting!  Where Marketing and PR Street crosses Legal Avenue.  Time for some university to teach a class in that.

One other thing you need to remember here, that Robert has pointed out many times on this forum:

Getty's rogue bot operates out of Israel.  That makes the bots actions not subject to U.S. Law.  Companies like Getty use their size to play different legal systems to their advantage against the little guy.
