It's fairly easy to beat back a collection agency ( at least here in the US)..simply tell them this is a claim and not a debt, until said "claim" is settled, they have no right to pursue you..Then report them to the proper agency.

I use 500px.com, the images there are uploaded by users and as far as I know the copyright and copyright enforcement would be the responsibility of the uploading user. Now they may have changed somewhat and could possibilty offer users the ability to allow 500px to handle this, alot has changed there since I first became a user, and I haven't posted any images there in a long time...

this actually hurts their cases even more, they would look like total idiots if they were to sue only to have someone come in and show the court, how one can disguise the image path.. I guess they could also maybe get a print out of the file directory/folder itself, but thats highly unlikely they would be that smart.

See that's the thing with emails, they ( the trolls) have no way of knowing if the correct party or anyone for that matter received hem. If it were me I would not respond, doing so only validates your email address, and gives them cause to harass you further.

most likely, they don't have anything, you are correct that a screen shot and a url don't show much. They woud have to have the underlying code to see where the image is actually hosted.. Probably explains why they rarely file suit too.

I read this today also, it does indeed pertain to DMCA takedowns. The issue I see with the demand letters are they don't always  request a take down, they always request payment for using the images. The letters don't follow dmca and the sender is not "swearing" to anything like in an official DMCA takedown.

In my opinion all owners should have to file an offical DMCA take-down notice before sending a demand letter, regardless of whether the site has a registered agent or not. But this won't happen, as this was largly how copyright law was set-up before DMCA, you had to send a cease and desist first, I highly doubt that will be brought back, these big companies, Getty, Masterfile, etc.. have deep pockets and can easily lobby asshats in Washington to not go that route..and we all know money talks.

Im curios as to what "proof" they have that you infringed, if it is a screen shot from your site, that does not prove infringement, it only shows that the images appeared on your site, there are several ways of doing this without infringing.
Also even if LCS does have the authority to "enforce copyright" I highly doubt they have the authority to file suit, as they are not a law firm, but rather a room full of collection clerks.

I'll even go one step further..IF and thats a BIG if!) they were to file suit, during "Discovery" I would summons Kjartan Dagbjartsson to appear and swear under oath that he singed this "contract" I doubt he would travel to the states...heck like Getty told me when I supplied a license for my image " anybody could make that, this is not sufficient"..

I hereby demand you pay me 5 red herring because:

a couple of comments and clarification..
DMCA won't apply to you, unless you have a registered agent and are an "internet provider" of sorts. Hiring an offshore development company would not apply. This is a major problem with these indian companies, they have no regard for copyright. Stating they go tthe image from a "free" wallpaper site and that they do this regularly is a very bad practice and many more of their clients will be in this same position.
In regards to filing lawsuits, the image does NOT have to be regisatered, however if it is not properly registered the amount awarded IF you lost would be much lower.

The amount they demand is likely pulled out of thin air, based on what they believe they can collct, no ryhme or reason, stinger is correct in stating that IF they filed suit, they may only "win" 200.00 which is far less than the cost to file in the first place, They would need to file in your home state, hire a local attorney etc. I highly doubt a company in Sweden will travel here to do this, and LCS which is actually Picscout, that is owned by Getty Images would not have the right to file suit, unless they have the exclusive rights to the image in question, which they probably don't.

At the end of the day, these are largely phishing expidiitons to see who will pony up cash without being educated, thats not to say I would ignore it, thats for you to decide, if it were me I would be naming and shaming the company, the photograper, picscout and getty images, and show them that I'm not putting up with any BS from them..keep reading, get educated, you have lots of options, including but not limited to filing complaints with the States Attorney General.

I don't think it's a matter of getting mixed up info, it's more like different options that are available all depending on your level of education, and what scenario would suit you best, based on your circumstances, the specifics of your "case" and your level of putting up with this BS. None of us here can "tell you what to do", that's something only you can decide based on the above.

I've never heard of this company before, you may want to search justia.com or pacer.org to see if they are "lawsuit happy", most likely not, or we would have caught wind of them sooner. I'm curious as to the amount they are demanding and whether it is somewhat more reasonabnle than what other trolls demand?
