Unfortunately, I agree with Oscar that a settlement is likely on the way.

But, as Robert says, I too would like to see Getty burned to the ground over this.

Awesome letter Matthew!  From the time I started my business career, I have always despised attorneys who attempt to wrap a cloak of secrecy around something that actually happened.

The letters speak for themselves.  The facts speak for themselves.  I sometimes wonder why everything isn't admissible in a court of law.  Bias??  The world is full of bias.  Ignoring something that happened biases the proceedings as much as shining a light on it.

Some lawyers use their degrees to push people around.  It's wrong.  And, I'm behind anyone willing to stand up to that.

So the question is, if we have a judge who says it is extortion, and we have the letters that do what the judge says is extortion, do we have a criminal case against Getty?

Or do the criminal courts see the definition of extortion differently than the civil courts?

Good story and great quotes on your part, Matt.

I would have found the story a lot more interesting if the reporter had delved into the numbers a bit more - and taken it right down to how much money the trolls earn from licensing versus from trolling.  Or even just asked the question, why are copyright images spread around illegally to the extent they are.

But, alas, the Fourth Estate is a wee vestige of what it once was.  It's why I, and a lot of people I know, ignore them much more than we ever did.

I thought we had a thread on here about companies, like Getty, taking NASA photos and making them available on their site for a charge.

I don't remember if they tried to troll users of those photos.  Does anyone else recall?

When Greg says these photos are safe, I think he means you shouldn't lose a lawsuit over a NASA image.  That doesn't mean some troll won't say you stole their photo and demand $1200 for it.  They can choose to hassle anyone.  It is just a lot easier to tell them to go pound sand when you know the photo was taken by the government and not a photographer.

I don't think I would worry about it. 

However, if you want them to stay on point or get off your back, you might respond with something about, "The continued unfounded claims being tossed at you by multiple parties constitutes harassment."  Let them know you have already responded and are awaiting proof of their claim.  Let them know that if the harassment doesn't stop, you will be going after them.  If you have a reputable attorney that you do business with, it would always be a good idea to cc him on the letter.

Sometimes these guys tend to chase their marks in multiple ways which really can be harassing.  Not only might they come at you themselves, but with an attorney, and sometimes with a bill collector.  You might put that to bed by letting them know that you are not interested in their harassment tactics.  "Cease and desist" so to speak.

So if Pinterest can be the next area for trolling, what of Facebook?  Do they copy the image or just link to it.  If I do a facebook share of an article I like, does it get copied or just linked to?  If I share an article that has a licensed image in it, I did not license the image.  Might I be responsible for anything I share?  Or have the facebook folks figured that out?

Being the little guys in this fight, should we be asking for full fledged reforms or should we wage a large number of smaller battles attempting to change  one thing at a time (like the propensity for large firms to use copyright law as a business plan to extort money from individuals and small firms)?

I expect the latter, however I could be wrong.  I am apolitical.  To top that off, I have little experience in these types of workings.  What do you guys think?
