Did you send them a letter letting them know this is a claim and not a debt?  IF not do so right away and let them know any further contact will result in a complaint to the FTC and AG's offices.  If you have sent them the letter I would be filing complaints on them by the end of the day.

You have made a MORE than generous offer which I would not have done if the images are different.  I also would not pay a penny until they can show you how they arrived that the images are the same (sometimes a part of an image such as a cloud may be used and pic-scout can detect it and I would also want proof they hold the exclusive rights they claim.

They are presenting you will a bill and no proof.

I remember one user a while back that contacted the artist over his letter and tried to plead his case of innocent infringement with him.  He said the artist told him the contract put the matter out of his hands and beside he wouldn't see a penny out of it anyway. 

This might be one of the reasons why Getty guards their contracts so closely.  They don't want it publicly know how bad their artists are screwed over. 

I'm wondering how the copyright owners (i.e. photographers) feel about this. Are they going to be paid when their image is "pinned"?  If they are, they might think it's fine. If not, many will be pretty pissed off.

It sounds like you image contained a picture of at least one person.  A model release should be part of an image containing a person.  If you intend on communicating with them make sure you read up and educate yourself first. Too many time people write a letter before they get educated and send in letters that may not help themselves very much.

Welcome to the forums Nazar.  If I was in the situation you have described I would tell them that I will only negotiate if they provide proof of claim and show they have exclusive rights you. 

The burden of proof id on Getty to show you have infringed and that you have not licensed the image from one of the other sites.

There is a lot of good information in the the forums, keep reading and educating yourself and you will see Getty's tactics and then you can decide what response is best for your situation.

Please keep us posted on what you decide to do.

Just refer to it as alleged infringement.  You can also look in the ELI Scribd library for letter sent from Oscar on behalf of clients.  I think there was a good one to Hawaiian Art Network that was sent out around the same time as the lawsuit against them.  Oscar did a beautiful job (as always) on that letter.

To answer you other question you will not see a class action suit against Getty over these letters in the states anytime soon.  You can search for class action and see this topic has been covered many times.

I'm a newbie and here are my questions ... 8)

Question 1 - Do you have an information about any class action lawsuits against getty ?

Question 2 - What is the best thing a new getty extortion letter recipient can do to help the cause ?

Robert is correct, Getty won't care and will tell you they appreciate your reply but you still own the money.  They will take a slight discount if you pay withing a certain time frame but you still owe the money.

Keep reading the forums and asking questions on anything you can't find or don't understand.

The odds are extremely remote that they would sue you especially if it is over one image.
