generally speaking, when there is a settlement or a judgement, there is a confidentiality clause included, hence you get no response.

Others have just ignored the e-mails from Getty Image. Is this a good idea?

ahhh yes a FREE IMAGE site!!! gotta love those "freebies"..

1. do you know where this "free image" site obtains their images?
2. do you have a license agreement to use these images?
3. did you purchase these images?
4 do you know the definition of "royalty free"
5. have you ever heard the phrase " you get what you pay for?"
6. or the phrase "nothing is free"
7. do you want more extortion like letters?

Thats exactly what you'll get by using "free image" sites..

Rest assured Oscar was not "forced" to post anything, just like You and I  we are free to post our opinions, Oscar has been dealing directly with Street and this Tylor thing, obviously he has seen things we have not, I'm sure he would not just simply change his opinion on a whim, does this make Vincent K. Tylor or attorney Stephen Street any less of an asshole..IMHO no, they are both trolls looking to make a quick buck.

If you allow other to upload videos, images you need to have a registered agent, to prevent this from happening in the future.. In regards to what to do, all of the info to make a sound decision to move forward is in the forums, do your homework and get educated.

do you really think a company in England is going to come to the US to file a suit? doubtful, Timothy B. McCormack is a douchebag of the highest magnitude, it won't be long before he involves himself.. If i were you I would not contact any of them any longer..BUT since you already did, they now know they have a fish on their hook, and they will probably continue to pester you to some degree. your options are either pay the 200.00 or deal with them for the next 3 yrs. ( statute of limitations).. So many people jump the gun and contact the trolls first, before getting educated, which in my humble opinion is a big mistake, but whats done is done..

Below is from a "friend" who shall rename nameless at this time and I totally agree with his thinking:

It all comes down to corporate marketing-speak, in my opinion.  "Fewer demand letters" simply means that they'll waste fewer resources on the really minor stuff and/or tracking down hard-to-find people/ those that lawyer up fast (Oscar?).  They'll go for low-hanging fruit.  "We'll settle for simply the regular license fee"  is the same old thing; when you complain about the enormous price, they send you to a web page proving that it's the true price... but they don't tell you that it was one-tenth the value yesterday.  All this from a corporation that doesn't own or even document its copyrights.

Some other food for thought:

We've recently seen letters being sent directly from Picscout (owned by Getty), would not surprise me one bit, if in an effort to cleanse their reputation, that they now send all letters from Picscout as opposed to Getty, as most laymen, would not put the 2 together. Does this possibly mean Seattle attorney Timothy B. McCormack main source of income is in jeopardy?..only time will tell. The letters I have seen from Picscout indicate they are all computer generated, so Getty could save some cash by trimming back it's "copyright compliance team" as well, so maybe Mr Bieker will have to get a full time job at a local soup kitchen.

Either way Getty Images, Picscout and Seattle Lawyer Timothy McCormack are NOT to be trusted, they are asshats of the largest magnitude.

don't say it "was an honest mistake" that admits guilt.. as for the price of the image, if you can find comparable images and see that getty has inflated prices, IF it were to go to court, a judge would most likely look at this and what others sites charge, and would take that into consideration.. chances are good a judge would not award the amount getty wants.

I think what you are overlooking here is the fact that your case differs from most cases we see.Most cases we see are for single/double infringements, naturally in a case with 6 images the chance of getting served is slightly higher. To make make a blanket statement that the letter program does not work is in-accurate, it does indeed work in most cases. Even iwth single image cases, there is always the chance that a suit may be filed, the defense letter is by no means a silver bullet guaranteed to make the issue at hand go away.

What you do at this point is completely up to you, clearly your attorney ( Oscar) has suggested settling the matter, I am quite sure there are underlying circumstances for him to suggest this, so your options are to either heed his advice, or ignore his advice and see what happens.

Being that this case involves 6 images, I'm concerned that you may have used other images from other companies in the same manner, I hope you took proactive steps to insure that any and ALL images you are using, have a valid license.

no need to worry about the house in Florida, they can't touch that either.. I agree with matthew in terms of the small business thing, If i were to be sued, there would be no assets they could get their hands on.

It could take months, it the US Government! I probably would have sent it registered mail receipt, to confirm they even got it..

Furthermore, if you hired Oscar, then Getty has NO business contacting you directly, any contact should go through Oscar's office, which I also suspect is the case. Oscar has dealt with literally 100's, probably closer to 1000 of these and Getty has never filed a lawsuit where he was involved, not did the letter "not work" for all of those.. Apparently your case is not a single infringement, and there is more to this story. Where the images removed immediately upon  getting the letter? how many images are we talking here?
