this exif doesn't tell us anything of importance. Many times the exif data is stripped by software, depending on what is used..Facebook for example strips all exif info when something is uploaded there, while flickr does not. Whats more important is to search and see if the image is registered with the copyright office.. Seattle Attorney Timothy B. McCormack is a hack attorney and most serves as a collection agent, he won't be the one to file suit.

pay no mind to their "confidentiality" clause, it means nothing unless both parties agree to it and it is signed somewhere, by both, kinda like a contract..your free to share it, and they have no recourse. I wouldn't worry to much about this, the site is gone and if you have no money and they sued, you'd still have no money.

If I were Linda Ellis ( glad I'm not!) I would be extremely pissed at her "legal team".. I'm no lawyer, but hell, they made so many dumb mistakes it's not even funny. Betsy McBride practically discredited herself in her opening statement, when asked a question, she did not answer, but tried to go in a different direction, she continually stated "they" as in "they post" "what they do", this case isn't about us or "they" it's about Matthew Chan.

Then naturally we have Seattle Attorney Timothy B. McCormack ( and coincidentally I found myself holding not one but 2 doors open for him, before the hearing..further proof that I'm a nice guy) who proudly took the podium and fumbled his way through.. Who the hell in their right mind mentions cross burning in a GEORGIA court, that just happens to have black justices??...and of course he had to get in the F.A.G.G.O.T. reference which in my opinion was just him trying to interject his own crap..

and Just for Timothy B. McCormack: It is not illegal to burn a cross, If I choose to do that in my own front yard, I have every right to do so, but If I do that on someone else's front lawn who happens to be a different race, than that is another story.

The more I think about this case, the more I feel it is "The Dash Poem" author Linda Ellis and Seattle Attorney Timothy B. McCormack, are the ones "stalking" after all they are the ones who come HERE and look into our window..continually..

if the images were linked, they have no case, they know this, chances are not high that they will file, and if they did file, you would need to answer to avoid a default judgement..BUT when you answer ( if they file) you can also file a counter-suit, which would put them in a very awkward position, which they could not escape. Sometimes engaging them, will just add fuel to the fire and you may make statements that do not help your cause. I don't think I would caontact them and ask them for any proof.. If you know for a fact the images were linked, you already have that, and they won't have anything, they are banking on the fact that you are ignorant and don't know anything about the case law of perfect10 v google.

probably because it one of those old laws on the books, that laregely un-forceable..much like having sex with a donkey is illegal on sundays in florida. Clearly, this "security person" has that typical cop complex. I once had a security guard approach me while I was on a public sidewalk, shooting some building/architecture.. Told me I could do that. I simply asked for his supervisors name and contact number...he walked away at that point.

In this case, I would totally ignore them.

Or consider filing a bar complaint & state attorney  complaint with whatever bar associations they are members of, it should be on them to do some simple fact checking before trying to squeeze money of out of anyone.

If users have no way of "uploading", then it's pretty safe to assume that the images in question were indeed hotlinked.

What stood out to me was, Getty saying that their nice little letter included "if you feel you have recieved this in error please contact us directly"...every letter states that.. how many times have people gotten this letter in error and contacted getty only to be told to pay up anyway.. I myself got the letter "in error", but was still told to pay or face a lawsuit..These bastards lie at every turn..I sincerely hope Lisa Wilmer, Douglas Beaker and Scott Wilsdon get to experience some first class butt hurt...To bad Seattle attorney Timothy B.McCormack is not involved.

Personally I hope there is no settlement until AFTER discovery, but I'm selfish.

you would need to be served in person, they have up to the 3 yr statute of limitations to do as they please, chances are good you will hear from Getty again, and they will escalate it to Seattle Attorney Timothy B.McCormack ( Note I use the term "attorney" very loosely, as he is more of a collection agent ), they may also send it to a collection agency, which is also discussed in great length on these forums.

If you can find the image in question on multiple sites, then Getty clearly does not have "exclusive rights" OR the artist is in breach of contract..either way this would weaken gettys case, Most of Getty's catalog is not registered, and they know this which also greatly reduces the amount they would be awarded IF they were to sue AND win. If it were me I would create a list of all sites this image is on, as well as the info from the copyright office, just to keep handy.

it's worth a shot , however if he is under contract with getty, he/she  most likely has granted permission to Getty to enforce his copyright.. I have seen firsthand where Getty tried to collect and the artist in question had previously severed all ties/ relationships with Getty images, so that tels you right there, that that artist was not going to be paid for anything. It would also be in your best interest to research the image in question and see if it is properly registered with the US Copyright office as well.
