So Soylent, what you are saying is that my license in Canada covers me in the U.S. even though John Smith, the U.S. owner of copyright rights, did not make a nickel on my use of the image?

Would John Smith agree?  What if the Canadian company undersold him?  Wouldn't he feel like his territory was being compromised by these Canadian licenses?  Would he harass me?  Would this make him want to become a troll to companies like mine that license the image elsewhere, but use it on the internet - where it is seen in his territory?

I just feel like the world needs one set of laws when it comes to the internet and all things digital.  Does anyone else agree?  Or have a better way to make this work for all partie?

I am still a little confused.  In Soylent's example, my multi-national company, with offices in the U.S. and Canada, can license the image in Canada for web use.

When John Smith, the U.S. rights holders sees the image in the U.S., he can threaten to sue me.  I can show him my Canada obtained license, but he can still threaten to sue me claiming that he has exclusive rights for the U.S.

As a decent, law-abiding customer, I am screwed.  Why would anyone want to deal with these issues?

We have had companies in India publish our press releases about our software products as their own.  It is crazy and I don't know what they can expect to gain, unless they are capable of delivering, training, and supporting our software.

Much like the FARS News agency, they do not even try to reword anything.  Our thought is that maybe they don't understand what we are writing about and fear looking stupid if they moved a few words around.

Google does make it easy though.  When we are searching for who might have picked up our press releases, we also find who stole them.

Lettered may be wrong about the statute of limitations.  I believe that begins when the infringement is found.  If the company in question found out about the infringement recently, through something like archive.org, you may still have the better part of three years ahead of you.

But don't worry.  Moe is spot on.  Read the forum.  Tell us more.  You will put yourself in the position of choosing how you wish to deal with this issue, rather than being bullied through it.

Ellie, an important point to remember is that Getty is chasing your client/friend because they appear to be the easier mark.  You made that clear to them in your correspondence with them.  If your client/friend had done that first, I believe they would be chasing you.

This is not about the law or the principal, this is about the money.  I definitely think that taking this message to your client/friend's customer is stepping across a line.  If you decide to go Greg Troy on them (which by the way I recommend, I found the process quite cathartic), I would make sure to bring this point up in your letters.  If you decide to hire Oscar on your and your friend's behalf, I would make certain to point this fact up to him.

Wow, a verdict like that would have to get Google's attorneys stirring.

I wonder what the rest of Europe and the rest of the world will make of this verdict.  It seems to me that if the Playboy affiliate did not want to let others get at the photos, they should have been password protected at least, or simply not internet accessible.

Robert, that is great to hear!  Coming from where I am, and seeing some of the titles associated with the videos to date, I wasn't sure I wanted to watch some of them.  I did because I too, have a major interest in the subject.  And I am glad I did.  But if I didn't want to watch, I could not see how they could bring anyone new into the ELI community the way they were wrapped.

But when you say the videos will be more search engine friendly, enough said.  I recognize the talent in this group with making that happen.

Like Mulligan, I generally prefer to read content rather than watch video.  But this video, in particular, brings out something you can't get from a transcript alone.  And that is the sincerity and the passion in this cause shared by the participants.

I am beginning to see how these videos can be an asset in the Great Troll Battles to come.

Well done guys!  Another great episode.

I have a thought for you on taking this to the next level.  Really, I am just spit-ballin and I might get some ideas that I can use in my work.  Either way, I am interested in where this might go.

SG, Robert, and the ELI community are so good at Search Engine Optimization and using the internet and search against the trolls, that I am thinking these videos need to get out there a little more.  There is some solid information presented by credible people who clearly know the topics they are talking about.  This could help more people find ELI and promote our message.  It could do wonders for the credibility of ELI and Oscar's legal practice. 

And I know I have said this before, but I want to take it a little further this time.  Why would anyone outside of the ELI community click on a 24 minute video entitled "Episode 7" or "Oscar, Matthew, and Robert threesome"?

My company is going through this very thought process now.  We have a lot of documentation and help desk troubleshooting documents indexed and available for the convenience of our customers.  We are thinking about turning some of the more prevalent help desk questions and even some training class curricula into videos.  But how do you get the search engines to find the video?  When you have hundreds or even thousands of videos published, it is important to put the right ones on the first page of a search.

Right now, our decision rests somewhere between these two extremes.  In the simplest case, we need a very descriptive title of the contents of the video.  This works better than "Episode 7", but not all that well for Search Engines.  In the extreme case, each video sits on a separate page with a complete transcript of what is said, as well as organizational captions to capture synonyms that people might be using to search.  This should get the videos found in appropriate searches.

If we go to the extreme, some people might skip the video and just read the transcript.  So then was it worth the effort to put the video together?  In some cases the video is helpful where there is some kind of computer interaction or interactive charts, etc.

I guess what I am saying is that you go through the time and effort to put these videos together, but they are only reaching a small fraction of the audience they might apply to.  A little wrapping might make them far more useful to the ELI target audience.  What do you guys think?  Does anyone have any good ideas for a compromise between the extremes of a good title and a complete transcript?  Is there technology out there that can help in wrapping the ELI videos for search engines?  Or is it too early in the life cycle to think about this?

Great episode guys!  My only recommendation is that you might consider changing the title.  "ELI Factor - Oscar, Robert & Matthew Threesome!" might leave some voyeurs who find this episode through a search engine a wee bit disappointed.

Let me suggest "Episode 6 - Pornography trolling; Trolling for Sales Taxes".

Greg, I didn't actually send my letter to the library of Congress, my Senator's people did.  But I did get a copy of an email from:

Her email said that she was forwarding my letter to the Copyright Office for their information.  So she might be a great place to start.

Today I received another letter back from my state senator.  It included a copy of an email from Pamela J. Russell, Legislative Counsel for the Library of Congress.  The library acknowledged having received my letter (which the senator's office had forwarded to them) and forwarding of it to the Copyright Office.

They indicate that they are "not in a position to provide legal advice" to me.  But they also did read the letter as they state "He is concerned that Getty and law firms are citing, and perhaps abusing, copyright laws in their efforts to collect money from individuals and small businesses that wish to avoid nuisance suits."  And they acknowledge that I "...appear to be seeking a legislative solution."

So "the beat goes on . . ."  Let the paperwork shuffling continue, and let's hope enough people in the Copyright Office have heard enough complaints about this issue that they will take some positive action.

I encourage you all to contact your representatives about this issue.
