Again, I want to thank you all on this forum for the help. I have prepared and sent my "letters" off to the Defense Letter Program with a request for instructions on how to pay the fee. I didn't see how that was done so I assume they'll let me know once they enroll me. I'll wait and see how this goes. I wish everyonw else the best of luck in dealing with this playground bully.

Looks like Vincent K Tylor has been rather busy as of late..worth noting in the below lawsuits, is that Glen Carner owner of Hawaiian Art network does not seem to be involved with these, and also it looks like photographer VK Tylor is showing his young son the ropes and how to become a prolific copyright troll..To bad the kid is going to get a very bad reputation very quickly thanks to his asshole father..

Pic-Scout can detect even a small portion of an image even if items are added, removed or just a tiny portion of a picture is taken and used in another picture.

Getty was sold to the Carlyle Group last year.

Fair use is a tough area and I usually leave those question for when Oscar drops in and answers questions.

If you want to display a picture to go along with a review I would hotlink to image rather than having on and displayed from my server, hotlinking is not currently not considered infringement see Perfect 10 v. Google.  I say currently because Perfect 10 has just brought a suit against Tumblr and if it goes Perfect 10's way it could effect many sites like Pinterest and other sharing sites.

Next Question:

While this does not pertain to an image, I'll do my best to make an analogy to where it can.

Let's say I'm doing a podcast and someone sends me their original music to have it featured on my show.  Am I able to use it without worry that someone in the future could come after me?

If it is their original music and they send it to you for the show you are fine, however I might ask for a letter or email granting permission just as a CYA.

Now for the graphic part: Let's say I am running a blog and someone sends me their original image to have it featured on my blog.  Am I able to use it without worry that someone in the future could come after me?

Same thing as above, if it is their artwork and they send it to you to use you are fine but I might ask for the letter or email as confirmation.

Again I appreciate all of the help here, more importantly I appreciate the patience you guys have with me and my silly questions.

It should be held in your District Court.

In a worst-case scenario and getty does take me to court, where would that take place?
would I be required to travel to their home state, or would it take place in mine?

Can anyone provide any potential details on this?

I do not think in the situation you have described they can do that.  It reminds me of a case Getty just lost not to long ago where a photographer was in Haiti when the big earthquake hit, he documented the devastation and suffering, since the island was in ruins he tweeted some of the photos so the world could see what had happened.  Getty, among others took these images without permission, finding out who they belonged to or compensating the photo journalist and put them on their site and even was licensing them as if they had the rights to the images.

So if someone takes your friends work and puts it on Getty the person who did it would be wrong.

Since Getty states in their extortion demand letters that it doesn't matter how the image got on your site you are still responsible and must pay I would say Getty is wrong too  ;)  :o

Oscar's letter program is a great value, he knows the copyright law inside and out and has handled over 800+ of these letters.  You get a letter sent to Getty which will stop Getty from contacting you directly, they must go through Oscar.  Should Getty decide to respond you get a follow up letter.  I would consider using Oscar's program if you are not going to fight it yourself and I would certainly do it before I gave a penny to Getty.

If you want to fight it yourself all the information should be here in the forums plus the people here can offer good advice, but you must ultimately decide what is best for you and your situation.

Thank you for the reply Greg.  And Thank You for your contributions here, over the last few days I've been getting up to speed on many others situations with Getty including your own, your letter campaign was an example of persistence and dedication, holy cow!

Thank you for your kind words, I am not done with them yet.  ;)

The "form" letter I received from Getty is a very bad quality photo copy and further, nobody has signed it or put their name to it so I have no person to reply back to, just a Case #.  They have also provided TWO mailing addresses.  A Canadian address on the Envelope (Brampton ON) and a US address inside the letter (Seattle WA), who do I send my reply to or both?

I might be partly responsible for the lack of names, we noticed the letters started being signed "Copyright Compliance Team" rather than an actual name not to long after I started encougaging those who felt wronged by Getty to file complaints and name not only the company but the person sending you the letter too.  Don't think the minions liked be named in extortion complaints that are public record.  :)

One interesting point is that they are demanding $950.00 for use of the image (which has now been purged from the non-public directory on our server) but in the same letter they offer to give me 5 images FREE if I settle the claim.  Doesn't that statement somewhat devalue their own images along with in a secondary way, their own ridiculous claims of value on the alleged infringement?

I don't think I've seen them do this before, would you mind sharing your letter with me to add to my library of information?  If so it can be emailed to [email protected]

IF you've not read this here is some good information on who you are dealing with, you may me under the assumption much as I was after I first got my letter you are dealing with a reasonable and ethic company.  You will see that Getty does not care about the who, what, where and why about the image they just want you money whether they have the rights to it or not.
