And I thought that I could think of lots of things to do with $217,223.04. 

It is quite clear that my simple brain is not nearly as creative as Matt Inman's.  He could start a whole new art genre:  making emotional statements with photos of obscene amounts of money.

I motion that we bequeeth ELI hero status upon Matt Inman.  Do I hear a second?

Greg, I like your salt in an open wound analogy.  To get the maximum effect, I always recommend rubbing the salt into the open wound with some extremely coarse sandpaper.

Safe to say, my fingers and toes are crossed.

Gotta love this paragraph.

"In effect, the pornography purveyors have developed a new business model using the court system to extort money from individuals who are merely identified by IP address and with no proof whatsoever that they downloaded copyrighted materials from the Internet. By extorting settlements of $1,000-$5,000 the pornography purveyors have developed a model whereby they can unlawfully gain more money than they can by selling access to their pornographic videos"

Sounds a lot like some other business models we hear a lot about around here.

I am not a lawyer, but when I read this letter it appears to acknowledge that this is not a debt, but a settlement demand.  "Our clients have provided you with a settlement demand . . . "

I thought that, by law, debt collectors can only collect on debts.  Seems fishy to me that they would acknowledge this in their letter.

I do like the part about "Please contact us immediately with any payment proposal you might have."  They would probably really, really, like that.

Great idea publicizing Getty's business model to potential buyers.  Here are two offshoot ideas for consideration:
  • Let's publicize the contact names and addresses of those potential buyers on ELI so we each can write letters talking not only about Getty's business model, but also our personal experience with the firm, what we think of it, etc.  Letting potential buyers know the myriad of dastardly things Getty has done to firm up it's position in the Troll business, and how we all feel about that.
  • Send a group settlement offer to Getty and their attorneys.  Something like, "If you offer to settle and hold harmless the below named individuals and companies from all all actions currently on the table including any alleged copyright violations, the individual group will refrain from publicizing your business practices with potential buyers of Getty Images.  We can include some of the write-ups we are contemplating for point 1 above.  I know that sounds somewhat extortion like, but it is certainly no worse than what they do.

What do you all think?

S.G. I remember that post. 

Somehow I thought the financial component that Moe brings up might have changed the picture a bit.  If we can figure out how to make this important enough to raise real money, and some of that money is sent to ELI because it handles the "education component", I thought that might change Matt's mind some.

However, Moe and I have not solved the issue of how to make this important enough to enough people that they donate money to be used only in this fight against Copyright Trolling.  We still have work to do, but it would be helpful to know how Matt would feel if we had Oatmeal type donations.

I am interested in Matthew and Oscar's opinion of this.

I also am wondering if there would be some way to tie this activity to the Israeli class action suit.  In other words, hit them on two fronts at once.

I like it Moe.  Victims Defense Fund has emotional appeal and using it to fund a class action suit to put a serious hurt on Trolls should strongly motivate the followers of this forum.

One key question is, Do we have the critical mass to get this off the ground?  Oatmeal had a large following and he engaged them by using the very reason they follow him.  He made fun of the situation and demonstrated that the situation could be a threat to him (and the reason his followers read him).  That meant that a high percentage of his readers got interested in helping and making a donation.

In my case, my readers are techies who usually are not in business for themselves.  Getty, HAN, et al are not necessarily a threat to them, but might be a threat to their companies.  But these firms usually don't go after good sized businesses.  And, if they did, it's not a "going out of business" threat.  How do we get them to feel as emotionally about this as those of us who have had our livelihoods threatened by the Trolls?

April's readers are people putting on auctions.  Will they feel strongly about Trolls?  Besides ELI readers, where can we find ways to emotionally connect outsiders to our cause.  We don't want this to steer money that might have gone to ELI to our class action fund.  I think we want a larger source of funds.

What Oatmeal did really well was to use the David/Goliath story to endear people to a philanthropic cause anyway - the money was eventually going to charity.  He was only going to borrow it to take a picture.  That made it almost a no lose situation for his readers.  They get the tax break of a charitable contribution and they  get to have a little fun by helping David slay Goliath.

I feel like we are on to something good here, but are missing an element or two that might make it truly successful and status quo changing.  Anyone have other ideas to contribute?

Scraggy, the more publicity this lawsuit gets, the more sweet music I keep hearing.  And I particularly love the last sentence.  "If successful, this action might prompt similar suits against copyright trolls across the world."

Not just a win for Oatmeal, but a big win for charity.

I keep trying to wrap my brain around how we can use charity fundraising to put a big Butthurt on Copyright Trolls everywhere, but alas my feeble brain can't seem to get me there.

Anyone have some ideas?

I get the fact that picscout doesn't play by our rules, but I would think that if Getty came across infringement information illegally, that information would not be presentable as evidence in court?  Or am I just watching too many legal TV shows?

On the other hand, if Getty isn't going to sue, but just harass someone, their job begins when they come across the illegally obtained information.  I guess that is bhuddaPi's point.

Good point Moe.  I wonder if any of the legal eagles out there can comment on the notion of a class action suit against Getty or picscout for illegal search, theft of bandwidth, etc.  I am fairly certain they don't have search warrants for what their bots are doing.

jt, the decision to settle or not can only be yours.  But before you make that decision, I strongly encourage you to get educated.  This forum is a great place to do that. 

Don't take the things McCormack might be saying about the law as gospel.  There are many sides to every story.  They paint thousands of pictures of the law per month aimed at trying to collect money.  They are good at painting their side of the story.  And they have a vested interest in doing so.

Besides some excellent "free" advice, this forum allows you some paid options if you would rather manage the fight than get into the ring.  Consider all your options before making a decision.

I don't think the current release of picscout allows them to identify moving pictures without audio.

Can anyone verify this?
