I try Helpi, I try. I think that many times people get frustrated by this claim and like to think "out of the box" but don't take the time to think it through in detail.  Its still better than just having everyone roll over though

The decisions in the Righthaven cases seem to suggest that just transferring the right to sue may not be enough to give that person the right to collect damages.  That it is an insufficient transfer of rights to allow the suit to  proceed. There may be other technical errors in the documentation. The problem as I keep rep[eating is that to test it all out may require expenditure of money beyond what it would take to settle. So as helpi points out the lawyers win.

I don't know that it will make MF stay out of court as opposed to at least testing your will to challenge them financially in court. At the same time, if someone had the money, MF may fold as they may not want a court ruling that the agreement is invalid which could end a significant number of their claims.

Good point SG and this was the issue in the Muensch case. Also, for our Canadian friends innocent infringement is a defense to damages in Canada. The court can only require you to cease and desist if you can establish innocent infringement.

Most of them of by way of default judgment - the deft does not appear and allows the entry of a judgment against it. I cannot comment further as I have represented many of the defendants who have been sued by MF.

Since we have begun our site, the settlement demands have come way down. I think it has a lot to do with the information we have been posting and is an attempt to get more people to pay something rather than reach out to us or ignore the issue entirely.

It is highly unlikely they will sue over a single image.  Take a look around the site, listen to some of the videos and get educated on the topic as best as possible.

Good advice.  Often these issue are also covered under "advertising liability" insurance as well. We advise every client who receives a Masterfile claim in particular (since they sue more often than Getty) that they should check to see if there is coverage for this claim.
