If CEG were/are using fake lawyer(s), then it's probable that they're "trolls", and their threat level is therefore lowered.
If you don't want the "harassment" from them, then consider Oscar's letter program.

I'd like to add that since the photos are posted all over the Internet, it would be difficult to prove that the site in question did much "damage" on its own.
Given that the photos are so ubiquitous.  In fact WE should be paid to look at Lohan's ravaged carcass.  lol

If they were to file suit eventually, the trolls can be "paid off" if absolutely necessary.
Divide the demand by 30, to arrive at 300 dollars in this case.  If they accept that, it's a "good deal".
They probably won't... if so, but divide by 20.  That's 450 dollars... a "fair" deal.
Worst case would be 10 percent or 900 dollars... not a good deal, but it gets you out of trouble.
I wouldn't pay more than that, though.  Those are my guidelines; if I'm "off" please feel free to comment.

For me personally, I'd set up a "corporation" and do all my online activities under that umbrella.
It protects your personal assets when done properly.  There's so much trolling going on.
But, that's just me.

You'll find that once you have to "charge" for your services, your "loyal customer base" will abandon you.
There's a HUGE market for "free work" which might give you the impression that there's a market for "paid work".

I'm not "bothered" by the parties involved - I've never had any dealings with them.
Your opinions don't bother me - I rather like the debate.  In any case, I think that we largely agree anyway.
My only real point here is that people should NOT pay up in the face of "questionable standing"...
that is when an extortion letter victim thinks that "they MIGHT have some proof... I better pay just in case".
Therefore, "my jimmies remain unrustled" as the meme says.

Lucia, I think that you misunderstood my posting somewhat, I'm simply explaining that I don't take anyone's word without proof.
My requirement of "proof" does not mean that I have automatically assumed that "Perfect 10" has no standing.
I would prefer that readers of the forum (many of them extortion letter victims) stop giving the copyright trolls "benefit of the doubt".
The burden of proof is ultimately upon the copyright troll, regardless of their reputation or how many pieces they registered in the past.

While you may feel that my worldview is based on the Getty "model", and that I assume that the other trolls are akin to Getty, that's simply your opinion.  I didn't say that.

The case that I was referring to is the famous "Mick Haig" / "Evan Stone" case:

Mick Haig/Evan Stone dropped the case, and copyright standing was one of the reasons for this.
We can discuss what a "win" for trolling victims is or isn't.  But, a "win" is a "win" in my book, and lack of copyright registration would have killed it regardless.

I'd like to reiterate that the concept that a troll "might have standing" is quite offensive to me.
Either an entity has copyrights registered or it doesn't.  There's no grey area.  If one asks for proof, and none is forthcoming, then there's your answer.
Additionally, all evidence must be submitted before any court foray.  There's no mystery.

I do wonder, however if Tumblr was sent a DMCA complaint in regard to this.

I don't think that the content in question had much value in the first place.

The articles were just exhibits used to extort money from people under the guise of "it's just cheaper to pay us, even if you're right".

Personally, I don't feel that the present laws are or were ever intended to be abused in the manner in which we see today.
I'd like to see laws updated to reflect recent advances in media/tech, however.

Additionally, I don't feel that anyone should assume that another party holds the copyrights to anything, especially in the face of trolling, or a lawsuit.
We can check those facts, and we need not assume anything.
Indeed, a porn company recently attempted to extort/troll/sue people whom allegedly downloaded a video.
Turns out that they didn't even copyright their own material.

I recall this person well, Lettered.  His arguments were an example of what's wrong with the industry, and he actually made Getty look bad.
He/she actually said that he/she was a lawyer.  Debating with this guy?  It was one of my "finest hours" on the Internet.
I cut my teeth debating (the losing parties might call it trolling) on USENET.  Remember USENET?
This person even threatened me (albeit informally) to sue me for slander.
But I like how Marc Randazza (yes, the guy who practically brought down Righthaven single-handedly) speaks of butthurt:

Yes, there's many extortion letter recipients who want advice.  The demand letters are sent en-masse daily.

But, copyright laws and trolling tactics haven't changed much at all, and the vast bulk of it has already been discussed on the forums.
For the most part, the letters are are simply "trolls", and there's no actual legal or ethical basis for somebody to pay.
Myself, I don't really respond to the "Got letter!  Wat do?!" topics anymore.  No offense intended, but the forum is already brimming with advice and facts.
Having studied this subject informally for some time, I've come to the realization what a sham the whole trolling business is.
I don't mean to sound insensitive, but once one comes that that realization (that it's 99.999 percent bullshit), it feels like a major chore just trying to calm people down.

Additionally, much of what might be discussed "privately" doesn't help the audience of forum readers as a whole.

On a personal note, I'm always interested in new developments, changes to laws, or the "personalities" the come out of the woodwork from time-to-time.

Interesting post.
But, IP addresses aren't very reliable for identifying actual users, and the "courts" know this.
Anyone accused has plausible denial unless other evidence can be found, and that's quite difficult to get.
It'll be interesting to see what comes of this.

This guy looks like a movie villain that I've seen somewhere.
You know, some actor that looks a bit odd in the first place, and then they add tons of make-up.
I'm thinking movies like "Dick Tracy" or one of the "Batman" films.
