My "impression" is that Fewer is researching such subjects, as many professors do.
I don't believe that he's actively defending people or giving advice in a legal fashion.

Michael Geist is a crusader, and you may find his site and writings to be of interest.

Getting back to Getty in Canada, they've not made many inroads as far as enforcing settlements in "a serious legal way".

The fact that the copyright trolls even bother to be concerned about the semantics that are used to describe their "industry" illustrates how desperate they really are.

Unless the actual copyright owner is really "wronged" in some egregious way, the business of copyright trolling is a PR nightmare.
Attempts to "sanitize" the language used to describe their tactics would have little effect in improving their reputations in any event.

McFilms, I agree with you completely.
We're also all aware of how court decisions can be unpredictable.
A well-thought out defense is paramount.

This brings to mind the case of Diodato vs Spade:

Although the photographs were similar, the concept was considered generic enough that Diodato lost the case.
Furthermore, the defendant Spade could show several other examples of such a photo concept being used for commercial purposes.

"Rather, both photos illustrate the freedom photographers have under the copyright laws to independently create their own conception and expression of a particular subject matter."

Even if a settlement was paid, it doesn't really prove that HAN could have won if the defendant chose to fight.

Anyone else recall that Getty was sued for imitating the work of one of it's former contributors who quit because Getty began paying less and less?
Getty won.  Kind of ironic.

"...the Judge granted Getty’s motion for attorneys’ fees in the amount of† $728.308.23 -- an extraordinary amount, especially given that there had been no trial and that it took nearly three years for Getty to acknowledge and pay over $100,000 in undisputed royalty fees.† What’s more, even though the appeal was fully briefed and oral argument was set for October, 2003, the Court ordered that the attorneys’ fee judgment be paid by September 12... Getty quickly sought to execute the judgment -- which would have happened before the appeal took place unless Gentieu was able to post a substantial bond (she wasn’t). Gentieu suddenly faced the real prospect of losing not just her tangible assets, but also all rights to her entire image collection."

Great post.  It's about time that victims demanded accountability.
I hope that they get somewhere with this.  I'd like to see this discourage others from inventing trolling schemes.

Not that Getty ever has legal standing to collect on behalf of the majority of its content providers.

Yes, it's just "greed"...
These things could more often be solved faster and more amicably if the demands were reasonable.
I know that Steve Pigeon wants to retire... but, I'm not sure if this is going to work.
MF has had some large (six-figures) awards in the past... however, I think that the "infringing" companies closed, and the owners simply opened new businesses.
I doubt that MF ever got a cent.

Thanks for posting this content; it's of great interest.
Thus far, I've read the complaint.  I'm no expert by any means.
What jumped out at me is that many of the pictures have the same copyright registration numbers.
They're demanding a lot of money, and I'm not sure that these compilations would really stand up to close scrutiny.
They're certainly in good hands with Oscar.

Looking forward to reading the rest of the documents..!
