a screen shot is not proof of anything, just that the supposed image may have appeared on the site, it could have been hotlinked from elsewhere, it could have been an ad appearing in a feed...so yeah, screen shots are pretty much useless for all intents and purposes. They have no case and they know it, but they will continue to harass you for your money.

So does anyone know the success rate in Oscar's program? I don't want to pay $200 only to have to pay Getty  eventually if he can't get this shut down

There have been ZERO lawsuits filed, Oscar has handled well over 800 of these letters. Some have chosen to settle, most have not. The 200.00 is well spent knowing that Getty and their pirate associates can no longer contact you..just this alone is worth it..

Your "Lawyer" is an idiot, I strongly suggest reconsidering ever using this person in the future...What kind of attorney working for a client, tells the opposing side to contact client? and then suggests the recipient offer a settlement for a completely different image?!

I own and have registered the phrase LiveLoveLaugh, please send me five thousand dollars or risk being sued!..Feel free to have your attorney contact me!!  We've seen loads of dumb lawyers here, but they are all on the opposing side, until now....

On a serious note, just because you made an offer to settle doesn't really mean much, you're entitled to change your mind.

Copyright infringement is a federal matter, and I belive this to be true in Canada as well...hence you won't see any prior cases in the small claims court dockets. Getty most likely won't sue over 3 images, but they will continue to hound you.

How do you know all of the images are registered? are you sure?

But yeah, first and foremost remove ALL of the images, even ones that aren't Getty's if you did not licence them..Lest other trolling companys come knocking.

Then either get with Oscar or hire an attorney..

Why would you offer to settle if the image in question was a different image?
Why would you believe anything that Nancy Monson states?? she simply wants your money and will say anything to get it..
If you contacted your lawyer, why didn't they send a letter on your behalf?

Getty's software has been known to make crazy mistakes, they know this. If it's a different image I would tell Monson and NCS to pound salt.

Have your attorney send a letter, or get  used to dealing with them for another 2 + yrs., they target low hanging fruit, and you've already dangled a 500$ carrot under their nose..

Today I got.. well.. a reply on my blog from NCS.
Now.. I've got by blog set up in such a way that new posts are not published until I approve them.
Strange thing is, it's a different case number than what getty provided.

No, it will never grace the pages of my blog, their reply.

However, what is to stop them from posting on my google+ page or on my myspace page?

NCS actually left a comment on your blog? You must be kidding! I would be contactng them directly and speaking to a "supervisor"...whomever left a comment should be out of a job.

My immediate thoughts would be Pinterest is doing this to avoid being sued by Getty Images for infringing on image Getty "claims" are theirs. While at the same time this will allow Getty Images to send out thousands upon thousands of new letters.. Pinterest has already changed their TOS to leave the pinner on the hook for any infringements, this will just help Getty expand their racket.  We should follow this closely to see exactly what transpires in the future..

it's possible that picscount followed the url of your page image, and scoured that url and found a hit, in laymans turns, I looked at your code and the images are coming from outside of your site, there may have been a cat/dog image in this directory, and getty is simply assuming the image appeared on your site.. they have no case, zero, nada, tell them to pound salt, as the image is not nor never was on your site, tell them you will file complaints if they continue to pester you, and if it were me I would also tell them, they will be invoice for every minute you have to devote to this..time is money....asshats

did they supply you a screen capture showing your page with the image on it?? I have seen examples where the image is never on the site, but is displayed by an ad feed, which would NOT be an infringement..IMHO this is a perfect scenario for filing complaints with the Wash. Attorney General, especially if they continue to hound you for no reason..

The trolls at Getty images living a different society, where one has to prove innocence. Hell even these so called "contracts" have been brought into question, as not being signed by both parties..
