entirely possible..and they probably did.

707
I think Getty monitors this forum, right?  If so they may have already seen your letter. ;)

Not that I think any of this really matters at all in the grand scheme of things . . .

Thanks Lucia, Robert & Greg for your responses.

Good that I did not send the letter yet  :)

Where can I find wording for a letter that does not admit to usage ?

Thats what I am seeking  8)

I await your replies.

Thanks,
Leslie

yes they do , and yes they have seen it, i'm sure..

708
I believe due to our wonderful government sutting down, that the search function may be disabled, I know they are not taking any new registrations.. Lucia is 100% correct, they don't need to know where any images come from.

709
I took the liberty to visit some of the referenced "free / public domain" site in the response letter, and some of them state that images may be copyrighted / trademarked and to use at your own risk... The real problem with these sites is noone knows for sure where the images are coming from, and IF they are indeed public domain.

Nothing bugs me more than seeing new folks that aren't educated send off letters that might do more harm than good..no offense to the OP, but IMHO this letter fed into Getty's hand, and my guess is they will take advantage of this...I hope I'm wrong.

it's evidence ( kinda sorta), they don't have it posted on their site for commercial gain...it's been discussed at lenght before in the forums, you can searh for it or take me at my word, it's a moot point and won't get you anywhere.

711
Welcome the the merry-go-round!...While a good letter on the surface, you'll get the standard reply and demand, doesn't much matter that the image may be available elsewhere for "free", that sdoesn't mean those other sources have permission to use the image in question.. Getty will claim you are still guilty, and they will back up that up with your own words in the letter, being as you freely admitted to using the image.. You never should have admitted anything, whether it was intentional use or not. For all they know you could have simply been linking to the image in question, which would not be considered an infringement, and they would have to prove their case...You've just taken that out of the equation.. a screen capture really is not proof of anything without the supporting code behind it...

I'm assuming you are referring to the screen capture in contained in the letter? If so it's neither here nor there.

Why?

Because you said: "They included a reproduction of images that we hold the copyright to. Can they do that? "

If your image was in the screen shot, yes they can do that, and no it would not be considered an infringment.

I was gonna follow directions, but when I saw that Oscar didn't, and put in a shameless plug for his good looks, I decided not to follow directions.  However, I did refrain from any plugs for my good looks, because, quite frankly, that is a competition Oscar wins hands down.

Well, I'd have to see a picture of Peeved before I'd hands down give Oscar an Oscar for Best Looks even though I'm impressed with his masculine features and friendly visage!

On the other hand, if we were handing out prizes for the most wizened face that has been battered and abused and lined and spotted by decades of dealing with the slings and arrows of outrageous fortune, I would with all humility submit my own mug for consideration to the jury.

Peeved??? Mulligan wants to see your picture!...Ms Mulligan probably just slapped in the back of the head..you know she likes to hover.. :)

ALL of the recipients are either individuals or small mom and pop shops, Getty knows better than go after any big companies, as they would most likely face counter-suits and would most likely lose.. Yes you sure tipped your hand to McCormack, he'll continue to push your buttons.

See! you're all a bunch of rebels! no wonder Getty doesn't get paid, you guys don't blindly do as they say.. I'm not getting into the looks debate for obvious reasons..

If you have a burning question for Matthew simply email your questions ( do not post them here ) to admin(at)copyright-trolls.com

Just a reminder as per the request to not post here. It is my understanding that these questions posted to Matt in the interview are to be "spontaneous".

Peeved wins a gold star, for reading and following directions..

I would send it to the address they have listed, if they don't get it, it's not your problem..actually I wouldn't contact them at all, regardless.

I thought April Brown had some very interesting ideas (and the connections to make them happen) about how to take the fight against trolls to the public through radio and TV.  What has happened to her and do you think she will return to this web site and contribute her ideas to the fight against Getty et. al.?

Aprils fight is not with Getty images, so I think her interest in them is pretty much non-existant, and the problem with where her interests lie ( no names mentioned) is that the vast majority of letter recipients, don't have the spine or balls to stand up for themselves.

Lets all give paralegal Kate Riley from the office of Seattle attorney Timothy B. McCormack, and nice welcome, as she's now been added to the ever growing list of scum-bag copyright trolls...
