The odds are extremely low that they will and pf course make sure the image has been removed from your site and server.  You have a 3 year SOL for them to do anything, once you pass that you are in the clear.  We generally use the date on the first letter you received as your start date.

I would get screen shots of the image on the other site and keep it for your records.  I would not engage them as it doesn't matter what you say they just want your money.  They would have a hard time proving they have exclusive rights to the image with it being offered on another site.

With what you have said I don't think you have much to worry about, I would just ignore them.

I agree with Stinger and Matthew, if it is just a single image I would just ignore them as they will not negotiate in good faith or provide any proof of claim.

I am facing the exact same problem as you.

In fact, I am also at the same stage.  Getty has replied to my email and stated the same thing regarding Rights Managed vs Royalty Free.  I have not crafted a reply.

Bear in mind though, that the Confirmation of Rights Holdership is nothing more than an internal document by Getty.  It does not prove anything.  What you wanna see from them, is a copy of the registration certificate.  It looks something like this:

I would love to hear any suggestions on how to proceed as well.

What I've read from the forums and everywhere else so far is to request for the actual Certificate of Registration from the US Copyright Office from Getty (in your case, LCS).  And of course, after that they would supposedly reply that it is confidential, in which case... you should tell them that you are willing to sign a confidentiality agreement.  That's as far as I know.

LCS is owned by Getty and send out letters on behalf of Getty Images as well as a long list of other clients.

As far as a modified image goes I have seen Getty send a letter where only a little white cloud that was in one of their images was added to a picture.

You also have the option of filing a complaint against Getty/LCS with the Washing State Attorney Generals office if you feel what they are doing is wrong.

Hmmm, I wonder if what they are using to find the images. It says on the BBB there is only 1 employee.  It seems like it would be hard for one person, even using a pic-scout type program to filter through all the data it you have multiple clients. I may have to look into this company a little more and see what I can dig up.

I agree with Matthew, if you hot linked the video you should be fine.  Let them know it was never on your servers.  They may still harass you as it is just about the money for them but if you can prove it was hot linked you should be in the clear, in my opinion.
