To quote Mr. Mulligan, I just shit myself when I read that post... misinformed is not even close, from the very first paragraph, which is full of incorrect information to the "lawyer" also giving bad info.. why not handle this the easy way...you've stated you yourself is for the most part judgement proof, and you have also stated that the LLC is bankrupt.. Tell Getty to pound salt, they are not going to sue you if you have nothing! hell even if you were a millionaire, the chances of Getty filing suit over a single is minscule.

For whgats it's worth, they would need to file in Arizona not Washington, and the filing fee is not 150.00, it would cost them much more to file and pursue this that what any judge would award..simple math.

Either option...bottom line is they have not proven anything, and McCormack is blowing smoke out his ass ( as usual) damages of 350k are only availalble if the image is registered, which it probably isn't, it would also need to be registered properly, which it probably isn't, and even then it would be up to a judge to make a decision on the amount, and I highly doubt any judge would award the maximum allowed amount for an innocent infringement of a single image.

Agreed, it's simple, they have not proven their claim, and as such this still remains as such, I would report them, and include every instance thereafter. This must be a newby with NCS, as we've never heard the reply like this before..If you do report them make sure to name the person that is contacting you as well.

hahah pretty funny...they have no way of knowing if you even get the emails, I say bin it and let them pick up the phone or send certified mail..at which time you can tell them to stuff it, as it's a claim.. If you already told them it is a claim and not a debt, I would advise replyinhg to them and making themn aware that you told them this was NOT a debt and to not contact further, and since they did also advise them, you will be filing a complaint as they are not following the fair debt act...and do just that!

One would think that rights managed images would only be available via one source...I smell a rat...or maybe it's just all of those assholes at Getty Images, and McCormack Intellectual Property Law I smell.

The staute is 3 years from when they discover the  so called infringement, if they and you have the screen shot that is dated it would be 3 yrs from them..to bad for them they let 4-5 months pass by.. They may continue to contact afterwards, but a quick reply telling them the statute has passed, and that you will file complaints with the porper offices will surely quiet them down.. I doubt Timothy B McCormack would welcome complaint to the bar association for such an issue..

I'm going to something  similar. However, I enter a potential client's domain name in a wordpress cms, not realizing that it was going to as if they owned the site. The site was clearly in development.  In addtiona, all of the content resides on my development web space and on pages that were not navigable from the home page, or for public use

not exactly sure where on the forum the video is, but here is a direct link to it on youtube...where he clearly states one thing but has his copyright clerks do the exact opposite..

Lisa Willmer is Jonathan Kliens in house "attorney" aka head copyright troll..she's in charge of the "copyright clerks" that have no legal experience and send out extortion demand letters..

Or better yet, inform getty images, that you did indeed pay for the image directly thru DK, and that DK gladly accepted the money for past use of the image, and that this matter is now closed.

The same would apply, whether it a tree and clouds, or a shot of two people shaking hands..Getty claims they are "rights managed" and we have seen where some of their "royalty free" images suddenly become rights managed.. They rarely if ever send letters for royalty free images, because these images are liekly to be available on other sites.. bottom line is they want your money, and for 1 image will most likely not file suit. so your options are the same as dicussed on the forum.

Ok maybe I wouldn't go that far..

Good catch, the only way I see this going anywhere is if Tylor submitted a takedown request and they ignored it, or if the image(s) in question were not uploaded by a user/subscriber. The DMCA does not cover the owners of a site if they upload infringing material.
